An Act to vest certain Lands in the Body Corporate called “The Mayor, Councillors, and Burgesses of the Borough of Onehunga.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Onehunga Borough Vesting Act, 1911.
2 Lands vested in Borough of Onehunga.
The lands described in the Schedule hereto are hereby vested in the body corporate called “The Mayor, Councillors, and Burgesses of the Borough of Onehunga”
in fee-simple for municipal purposes; and the District Land Registrar of the Auckland Land Registration District shall, on the request of the Onehunga Borough Council, issue a certificate of title therefor to the said body corporate.
3 Saving of riparian rights.
Nothing in this Act shall affect any existing right of water-frontage or riparian right (if any) which may belong to any owner of land.
4 Waterway to be reserved.
In the event of any portion of the land firstly described in the Schedule hereto being reclaimed from the sea, there shall be left on the western side thereof from the sea to Mill Street, for the use of the public, a waterway of thirty-three feet in width.
Schedule
1.
All that area, containing by admeasurement 75 acres 1 rood 24 perches, in and adjacent to the Manukau Harbour: bounded as follows—commencing at a point being the extreme south-western point of Allotment 45 of small lots near the Town of Onehunga, included in the Cemetery Reserve; thence on the south by straight line drawn from the before-mentioned point to a point on the eastern boundary of land taken for railway purposes by Proclamation No. 784 (said point being on a straight line from first-mentioned point to a point where a production of the south-western boundary of Ferry Street, otherwise known as Water Street, towards the south-east intersects high-water mark); thence on the west by land taken by said Proclamation and land comprised in lease registered in the Deeds Registry Office, Auckland, as No. 89079; thence generally on the north and north-east by Mill Street, Victoria Street, and Allotments 18, 19, and 20 of Allotment 27 of the Borough of Onehunga; thence on the east by Alfred Street; thence by the seaward boundary of Allotments 61, 44, and 45 of small lots near the Town of Onehunga to the point of commencement.

All that area of tidal lands, containing 4 3/4 acres, more or less, being all the tidal lands lying to the northward of a straight line drawn from the south-eastern point of Allotment 48 of small lots in the Town of Onehunga to the south-western point of Allotment 49 of such small lots, the boundaries of such area being the said line and the shore at high-water mark between the said points.
