An Act to vest certain Lands on the Foreshore of the Whangarei River, at Whangarei, in the Whangarei Harbour Board
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whangarei Foreshore Vesting Act, 1913.
2 Act deemed special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1908.
3 Vesting certain lands in fee-simple in Board.
On the passing of this Act the lands described in the First Schedule hereto shall vest in and be the property of the Whangarei Harbour Board (hereinafter referred to as the Board) for an estate in fee-simple, and the Governor is hereby empowered to sign a warrant authorizing the issuing of a Crown grant or certificate of title, as the case may require, for the said lands to and in favour of the Board.
4 Power to sell or exchange certain portions of freehold lands.
The Board may sell or exchange those portions of the lands, being parts of Lots 9, 29, 30, 34, and 35, referred to in the First Schedule hereto, to or with Herbert Robins Cooke or other the owner or owners of the lands adjoining or adjacent thereto, being parts of Lots 6, 7, 8, and 33, subdivision of part of Allotment 1 of the Parish of Whangarei, and being part of the land included in certificate of title, Volume 168, folio 84, of the Land Transfer Register-book, at Auckland, for the purpose of making uniform or rectangular the boundary-lines to the said lots.
5 Vesting certain endowment lands in Board.
On the passing of this Act the lands described in the Second Schedule hereto shall vest in and be the property of the Board as endowment lands.
SCHEDULES
FIRST SCHEDULE
ALL that parcel of land, containing by admeasurement 2 roods 0‧6 perch, more or less, situate at Whangarei, being part of the foreshore of the Whangarei River and formerly known as Lots 31, 32, and parts of Lots 6, 7, 8, 9, 29, 30, 33, 34, and 35 of Section 3 of Reyburn’s Subdivision of part of Allotment 1, Parish of Whangarei: bounded towards the north by other portions of the said foreshore, 313‧24 links; towards the east by part of Lots 35, 34, 33, 6, and 7 of a subdivision of part of the said Allotment 1, by lines 180‧07 links, 90‧17 links, and 67‧37 links; towards the south by James Street, 49‧34 links; and towards the west by parts of Lots 8, 9, 30, and 29, by lines 155‧94 links and 141‧92 links: as shown in diagram 1 of sheet 2 of the plan deposited in the office of the Chief Surveyor at Auckland as No. 17229 (blue), and therein edged blue.
SECOND SCHEDULE
ALL those portions of land in the Whangarei Harbour within Block IX of the Whangarei Survey District, and comprising portions of the foreshore of the Whangarei River lying between high- and low-water mark of the said river at ordinary spring tides, and more particularly described hereunder:—

All that area comprising 1 acre 2 roods 39 perches, more or less, as shown marked “A”
on sheet No. 1 of the plans deposited in the office of the Chief Surveyor at Auckland as No. 17229 (blue), and therein edged red.
2.
All that area comprising 3 acres 1 rood 19 perches, more or less, as shown marked “B”
on sheet No. 1 of the plans deposited and numbered as above mentioned.
3.
All that area comprising 1 rood 26 perches, more or less, as shown marked “C”
on sheet No. 1 of the plans deposited and numbered as above mentioned.
4.
All that area comprising 2 roods 33 perches, more or less, as shown marked “D”
on sheet No. 1 of the plans deposited and numbered as above mentioned.
5.
All that area comprising 6 acres and 19 perches, more or less, as shown marked “E”
on sheet No. 1 of the plans deposited and numbered as above mentioned.
6.
All that area comprising 4 acres 2 roods 14 perches, more or less, as shown marked “F”
on sheet No. 1 of the plans deposited and numbered as above mentioned.
7.
All that area comprising 6 acres and 24 perches, more or less, as shown marked “G”
on sheet No. 2 of the plans deposited and numbered as above mentioned.
8.
All that area comprising 3 acres 1 rood 29 perches, more or less, as shown marked “H”
on sheet No. 2 of the plans deposited and numbered as above mentioned.
9.
All that area comprising 2 acres 1 rood 19 perches, more or less, as shown marked “J”
on sheet No. 2 of the plans deposited and numbered as above mentioned.
10.
All that area comprising 5 acres 1 rood 22 perches, more or less, as shown marked “K”
on sheet No. 2 of the plans deposited and numbered as above mentioned.
11.
All that area comprising 47 acres 2 roods 15 perches, more or less, as shown marked “L”
on sheet No. 3 of the plans deposited and numbered as above mentioned.
