An Act to authorize the Borough Council of the Borough of Wanganui to make and levy a Special Rate on all Rateable Property in the said Borough for the Purpose of the Repayment of various Loans and the Interest thereon, and to raise various Moneys by Special Order.
Preamble.
WHEREAS by Proclamation of His Excellency the Governor made pursuant to paragraph (d) of section one hundred and twenty of the Municipal Corporations Act, 1908, on the nineteenth day of December, nineteen hundred and twelve, and published in the New Zealand Gazette of the nineteenth day of December, nineteen hundred and twelve, No. 92, at page 3617, the Corporations of the Mayor, Councillors, and Burgesses of the Borough of Wanganui and the Borough of Wanganui East, boroughs duly constituted under the Municipal Corporations Act, 1908, were constituted one borough as and from the first day of January, nineteen hundred and thirteen, under the name of the Borough of Wanganui: And whereas the Council of the Borough of Wanganui, as constituted prior to the said Proclamation, had, pursuant to the powers vested in it by the statutes then in force, raised various special loans, the amounts whereof, the special rates made and levied for the repayment thereof, and the interest and charges thereon, and the rating-areas affected thereby, are particularly set out in the First Schedule hereto: And whereas the Council of the Borough of Wanganui East, as constituted prior to the said Proclamation, had, pursuant to the powers vested in it by the statutes then in force, raised various special loans, the amounts whereof, the special rates made and levied for the repayment thereof, and the interest and charges thereon, and the rating-areas affected thereby, are particularly set out in the Second Schedule hereto: And whereas since the making of the said Proclamation the Council of the Borough of Wanganui authorized the raising of a certain special loan, the amount whereof, the special rate to be made and levied for the repayment thereof, and the interest and charges thereon, and the rating-area affected thereby, are particularly set out in the Third Schedule hereto; and at a poll of the ratepayers of the special-rating area affected thereby, held on the thirtieth day of April, nineteen hundred and thirteen, the proposal to raise such loan was duly carried: And whereas it is expedient in the interests of the Borough of Wanganui, as constituted by the said Proclamation, that one special rate providing for the payment of the sinking funds established in respect of the various loans raised prior to the said Proclamation, and the interest payable on such special loans, and providing for the repayment of such of the said special loans and the interest thereon as have been raised in terms of the New Zealand State-guaranteed Advances Act, 1909, by the periodical payments provided by that Act, and providing for the payment of the sinking fund to be established in respect of the loan mentioned in the Third Schedule hereto, and the interest and other charges payable thereon, shall be made and levied upon all rateable property within the Borough of Wanganui as constituted at the time of the making and levying of such special rate:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Wanganui Borough Council Special Rate Empowering and Special Loan Act, 1913.
2 Interpretation.
In this Act—
“The Wanganui Borough” shall mean the Mayor, Councillors, and Burgesses of the Borough of Wanganui as constituted under the Municipal Corporations Act, 1908, the area whereof is defined by Proclamation of His Excellency the Governor of the nineteenth day of December, nineteen hundred and twelve, and published in the New Zealand Gazette, nineteen hundred and twelve, No. 92, at page 3617:
“Council” means the Borough Council of the Borough of Wanganui.
3 Power to levy special rate.
The Council may, for the purpose of providing for the payment of the sinking funds established in respect of the loans enumerated in the First and Second Schedules to this Act, and the payment of interest on such loans, and for the purpose of providing for the payment of such of the loans and the interest thereon as have been raised in terms of the New Zealand State-guaranteed Advances Act, 1909, by the periodical payments as provided by that Act, and for the purpose of providing for the payment of the sinking fund to be established in respect of the loan mentioned in the Third Schedule to this Act, and the payment of interest and other charges thereon, make and levy a special rate upon all the rateable property (on the basis of the annual value thereof) of the Borough of Wanganui as constituted at the time of the making or levying of such rate.
4 Rates not to be levied.
From and after the passing of this Act it shall hot be necessary for the Council to levy or collect the special rates made for the purposes of providing for the payment of the loans or the interest thereon enumerated in the First and Second Schedules to this Act.
5 Application of moneys raised by special rate.
The Council shall, out of the moneys raised by the making and levying of the said special rate, pay—
(a.)
The interest from time to time payable in respect of the said loans;
(b.)
The amount payable from time to time to the Commissioners of the sinking funds established or to be established in respect of the said loans; and
(c.)
The periodical payments of principal and interest payable in respect of such of the said loans as are payable to the New Zealand State-guaranteed Advances Department.
6 Acts incorporated.
The provisions of the Local Bodies’ Loans Act, 1913, the Municipal Corporations Act, 1908, and the Rating Act, 1908 (relating to special rates), are incorporated herewith.
7 Rights of debenture-holders not affected.
Nothing in this Act shall affect the rights of the holders of debentures issued in respect of any of the said loans.
8 Power to raise special loan of £5,000 for certain purposes.
(1.)
The Council may by special order and without taking the steps described in sections eight to twelve of the Local Bodies’ Loans Act, 1913, raise a special loan of five thousand pounds at a rate of interest not exceeding five and a half per centum per annum, to be applied within the area included in the Borough of Wanganui by Order in Council dated the twentieth day of September, nineteen hundred and nine, published in the New Zealand Gazette No. 86, 1909, at page 2577, and commonly known as St. John’s Hill, on the construction of such public works as the Council by special order determines.
(2.)
The special rate for the purpose of providing the interest and sinking fund and other charges payable in respect of the said loan shall be levied over all rateable property within the Borough of Wanganui the boundaries whereof are defined by Order in Council dated the nineteenth day of December, nineteen hundred and twelve, published in the New Zealand Gazette No. 92, 1912, at page 3617.
