An Act to authorize the Invercargill Borough Council to make and levy a Special Rate for the Purpose of the Repayment of various Loans and the Interest thereon.
Preamble.
WHEREAS by Proclamation made pursuant to the Municipal Corporations Act, 1908, on the twenty-second day of December, nineteen hundred and nine, and published in the New Zealand Gazette on the twenty-second day of December, nineteen hundred and nine, at page 3299, the boroughs of Invercargill, Avenal, Gladstone, North Invercargill, and East Invercargill, boroughs duly constituted under the Municipal Corporations Act, 1908, were constituted one borough as from the tenth day of January, nineteen hundred and ten, under the name of the Borough of Invercargill: And whereas by Proclamations made pursuant to the Municipal Corporations Act, 1908, on the fourth day of July, nineteen hundred and ten, on the twenty-third day of March, nineteen hundred and eleven, and on the seventh day of July, nineteen hundred and fourteen, and published in the New Zealand Gazette on the seventh day of July, nineteen hundred and ten, on the thirtieth day of March, nineteen hundred and eleven, and on the ninth day of July, nineteen hundred and fourteen, respectively, the boundaries of the Borough of Invercargill were altered so as to include certain areas as set forth in the said Proclamations: And whereas the Councils of the boroughs of Invercargill, Avenal, Gladstone, North Invercargill, and East Invercargill as constituted prior to the said Proclamation dated the twenty-second day of December, nineteen hundred and nine, had, pursuant to the powers vested in them in that behalf, raised various special loans, the amounts whereof, the special rates made and levied for the repayment thereof, and the rating-areas affected thereby are particularly set out in the First, Second, Third, Fourth, and Fifth Schedules hereto respectively: And whereas since the making of the said Proclamation dated the twenty-second day of December, nineteen hundred and nine, the Council of the Borough of Invercargill as thereby constituted has, pursuant to the powers vested in it, raised various special loans the amounts whereof, the special rates made and levied for the repayment thereof, and the rating-areas affected thereby are particularly set out in the Sixth Schedule hereto: And whereas it is expedient in the interests of the Borough of Invercargill that one special rate providing for the payment of the sinking funds established in respect of the various loans hereinbefore referred to and the interest payable on such loans shall be made and levied upon all rateable property within the whole or any part or parts of the Borough of Invercargill as constituted at the time of the making and levying of such special rate:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows
1 Short Title.
This Act may be cited as the Invercargill Borough Council Special Bate Empowering Act, 1918.
2 Power to levy special rate.
The Invercargill Borough Council may for the purpose of providing for the payment of the sinking funds established in respect of the loans mentioned in the First, Second, Third, Fourth, Fifth, and Sixth Schedules to this Act, and for the purpose of providing for the payment of interest and other charges thereon, make and levy a special rate on all the rateable property within the whole or any part or parts of the Borough of Invercargill as constituted at the time of the making or levying of such rate, on the basis of the system of rating for the time being in force in the borough.
3 Rates not to be levied.
From and after the passing of this Act it shall not be necessary for the Invercargill Borough Council to levy or collect the special rates previously made for the purpose of providing for the payment of the loans enumerated in the First, Second, Third, Fourth, Fifth, and Sixth Schedules to this Act or the interest thereon.
4 Application of moneys raised by special rate.
The Invercargill Borough Council shall out of the moneys raised by the making and levying of the said special rate pay—
(a.)
The interest from time to time payable in respect of the said loans:
(b.)
The amount payable from time to time to the Public Trustee as Commissioner of the sinking funds established in respect of the said loans, or to the Commissioner or Commissioners for the time being of the said sinking funds.
5 Acts incorporated.
The provisions of the Local Bodies’ Loans Act, 1913, the Municipal Corporations Act, 1908, and the Bating Act, 1908, relating to special rates are incorporated herewith.
6 Rights of debenture-holders not affected.
Nothing in this Act shall affect the rights of the holders of debentures issued in respect of any of the said loans.
