An Act to effect an Exchange of certain Lands between the New Plymouth Borough Council and the New Plymouth Harbour Board.
Preamble.
WHEREAS the Mayor, Councillors, and Burgesses of the Borough of New Plymouth (hereinafter called the Borough Council) are seised of or entitled to the parcels of land described in the First Schedule hereto: And whereas the New Plymouth Harbour Board (hereinafter called the Board) is seised of or entitled to the parcels of land described in the Second Schedule hereto: And whereas the Borough Council and the Board are desirous of effecting an exchange of the said lands:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Plymouth Borough and Harbour Board Exchange Act, 1918.
2 Lands in First Schedule to vest in Harbour Board. Lands in Seoond Schedule to vest in Borough Council.
Upon the passing of this Act the parcels of land described in the First Schedule hereto shall vest in the Board in fee-simple (subject to any existing leases or other interests affecting the same), to be held by the Board upon the like trusts and for the same purposes as those upon or for which the lands described in the Second Schedule were held by it immediately prior to the passing of this Act; and the parcels of land described in the Second Schedule hereto shall vest in the Borough Council in fee-simple (subject to any existing leases or other interests affecting the same), to be held by the Borough Council upon the like trusts and for the same purposes as those upon and for which the lands described in the First Schedule hereto were held by it immediately prior to the passing of this Act.
SCHEDULES
FIRST SCHEDULE
All that area of land in the Borough of New Plymouth, containing 1 rood 12·59 perches, be the same a little more or less, being subdivisions numbered 1, 2, and 3 of Section 2335 on plan 1282, deposited in the office of the District Land Registrar at New Plymouth, and bounded towards the north-west by Ariki Street, 147·29 links; towards the south-west by Egmont Street, 74·83 links; towards the south by King Street, 152·88 links; and towards the north-east by Subdivision 4 of Section 2335, 115·82 links, together with sections numbered 2336 and 2337 on plan 1164, deposited in the office of the District Land Registrar at New Plymouth; and bounded towards the south-east by King Street, 200·75 links; towards the south-west by Subdivision 5 of Section 2335, 141·1 links; towards the north-west by Ariki Street, 100 links; towards the north-east by Allotments 43, 44, and 45 of Subdivision 3, Mount Elliot Harbour Reserve, 94 links; again towards the north by Allotment 45 of Subdivision 3, Mount Elliot Harbour Reserve, 100·75 links; and again towards the north-east by Brougham Street, 47·1 links.
SECOND SCHEDULE
All that area of land in the Borough of New Plymouth, containing 3 roods 16·2 perches, be the same a little more or less, being allotments numbered 4, 5, 6, 7, 8, 26, 27, 28, 29, and 30 on plan 578, deposited in the office of the District Land Registrar at New Plymouth, and bounded towards the north-west by St. Aubyn Street, 355·78 links; towards the north-east by Egmont Street, 182·24 links; towards the southeast by Chilman Street, 350 links; towards the south-west by the Mangaotuku Stream and the eastern boundary of Allotment 3 on deposited plan 578 before mentioned.
