An Act to amend the Whakatane Harbour Act, 1921–22.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whakatane Harbour Amendment Act, 1922, and shall form part of and be read together with the Whakatane Harbour Act, 1921–22, which Act is hereinafter referred to as the principal Act.
2 Amending the definitions of the Opouriao and Rangitaiki Wards.
The Third Schedule to the principal Act is hereby amended by repealing the descriptions of the Opouriao Ward and the Rangitaiki Ward, and by substituting the respective descriptions in the Schedule hereto.
3 Amending subsection (3) of section 5 of principal Act.
Subsection three of section five of the principal Act is hereby amended by omitting the word “twenty-four,”
and substituting the word “twenty-three.”
4 Providing for date of election of elective members.
The first election of the elective members of the Board shall be held in the month of April, nineteen hundred and twenty-three.
5 Defining “elector.”
The following definition shall be added to section two of the principal Act:—
“‘Elector’ means a ratepayer of the harbour district as limited by subsection three of section three of the principal Act.”
6 Failure to pay rates a disqualification for voting purposes.
It shall be the duty of the Board to supply to the Returning Officer, not later than ten days before the date fixed for the holding of any election or the taking of any poll, a list of all ratepayers whose rates or any part thereof are then unpaid and have remained unpaid for a period of not less than nine months, and no person whose name appears on the list supplied as aforesaid shall be entitled to vote at that election or poll unless he shall before voting pay to the Board, its Clerk or Treasurer, the amount owing by him, and produce a receipt showing that he has so paid.
7 Failure to pay rates a disqualification for nomination purposes.
No person whose name appears on a list of ratepayers supplied pursuant to the foregoing section in respect of any election shall be competent to nominate any person as a candidate or to be himself nominated as a candidate for that election, and his signature on any nomination-paper (whether as a nominator of any other person or in signification of his assent to be nominated as a candidate) shall be deemed to be a nullity, whether such nomination-paper is received by the Returning Officer before or after the list has been furnished to the Returning Officer.
8 Enabling Board to accept leases.
It shall be lawful for the Board to accept from His Majesty the King, or the Government of New Zealand, or any other person, a lease of any land for harbour-works.
9 Restricting right of Board to levy dues in respect of Tarawera Harbour.
Notwithstanding anything to the contrary in the Harbours Act, 1908, or in any other Act, the Board may, in respect of the Tarawera Harbour, levy dues only for the purpose of improving and maintaining that harbour, and providing and maintaining facilities in connection therewith for navigation and the handling of goods and passengers.
Schedule
Opouriao Ward
All that area in the Auckland Land District bounded towards the north generally by the Omataroa Ward, from the eastern boundary of Allotment 60b, Rangitaiki Parish, to the north-west corner of Allotment 346, Waimana Parish, and the northern boundary of that allotment; towards the east generally by Allotments 330, 316, 317, 328, and 329, Waimana Parish, and by the eastern side of the road intersecting Allotment 307 of that parish to Allotment 307a (closed road), and by the general eastern boundary of Allotment 307a aforesaid and the crossing of a public road to the Waimana River, by the said river to the confiscation boundary-line, and by that line to the western boundary of Block III, Waimana Survey District, by that block and Blocks VII, XI, and XV of the said survey district, and Blocks III, VII, XI, and XV, Urewera Survey District, and Blocks III, VII, XI, and XV of the Ruatahuna Survey District; and generally towards the south by the southern boundaries of Blocks XIV and XIII of the said Ruatahuna Survey District and the southern boundaries of Blocks XVI, XV, XIV, and XIII of the Ahikereru Survey District to the point of intersection with the eastern boundary of the East Taupo County; and towards the west generally by the aforesaid county boundary to the Kuhawaea No. 1 Block, by that block and Waihau Nos. 1b, 1a, and 2 Blocks, the Tuararangaia No. 1b Block, and Allotments 60c and 60b, Rangitaiki Parish, to the place of commencement.
Rangitaiki Ward
All that area in the Auckland Land District bounded towards the east generally by the western boundary of the Omataroa and Opouriao Wards, from the sea to the point of junction of the western and southern boundaries of the Opouriao Ward, and by the western boundary of the Whakatane County to its point of junction with the southernmost boundary of the Whakatane County; and thence towards the south by a straight line to trig called “Pukeroa”
; thence by a straight line to trig called “Kokomoka”
; and thence again towards the east by a line due south to the point of intersection with the Taupo–Napier Road; and thence again towards the south by that road to the point of intersection with the western bank of the Rangitaiki River; and generally towards the west by the western bank of the Rangitaiki River to a point on the river-bank intersected by a projection of the westernmost boundary of the Whakatane County which passes through trig called “Ahiwhakamura”
; and thence by that boundary to Trig. 18 (Maungawhakamana); towards the north-west by the confiscation boundary-line to the west bank of the Tarawera River; and again towards the west by the west bank of the aforesaid river to the north-western corner of Allotment 4, Block III, Awa-o-te-atua Survey District; and thence in a northerly direction along the western bank of the proposed Tarawera outlet to the high-water mark, Bay of Plenty; and thence towards the north-east by the sea to the place of commencement.
