An Act to amend the Canterbury College and Canterbury Agricultural College Act, 1896.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Canterbury College and Canterbury Agricultural College Amendment Act, 1922, and shall be read together with and deemed part of the Canterbury College and Canterbury Agricultural College Act, 1896 (hereinafter referred to as the principal Act).
2 Increasing number of members of Board of Governors.
On and after the passing of this Act the number of members constituting the Board of Governors of the Corporation of the Canterbury College shall be twenty, anything to the contrary in section three of the principal Act notwithstanding.
3 Section 5 of principal Act amended.
(1.)
Section five of the principal Act is hereby amended by omitting the word “nineteen”
; and by repealing paragraph (6), and substituting therefor the following:—
“(6.)
Two members of the Professorial Board of Canterbury College, one of whom shall be the Bector so long as the office of Rector is maintained, and the other shall be elected by the Professorial Board.”
(2.)
Notwithstanding anything in the foregoing provisions of this section, the member of the Board elected by the Professorial Board and in office on the passing of this Act shall continue to hold office until the first day of July, nineteen hundred and twenty-four, or until he shall cease to be a member of the Board under the provisions of section nine of the principal Act; in which case there shall be a casual vacancy, which shall be filled by the election of a member of the Professorial Board, who shall hold office for the residue of the term of the vacating member.
4 Rector forthwith to assume office as member of Board.
The Rector shall take office as a member of the Board of Governors immediately on the passing of this Act.
5 If office of Rector vacant, additional representative of Professorial Board to be elected.
In the event of the office of Rector becoming vacant and of the Board of Governors of Canterbury College deciding not to appoint to the vacancy and to discontinue the office, and giving to the Professorial Board notice of such decision, the vacancy thus caused on the Board of Governors shall be deemed a casual vacancy, and shall be filled by a member of the Professorial Board to be elected by the Professorial Board, who shall hold office until the expiry of the term of office of the other elected representative of the Professorial Board or until the appointment of a Rector, whichever event shall first happen.
6 On appointment to office of Rector, one representative of Professorial Board to retire.
In the event of the appointment of a Rector when there are already two elected representatives of the Professorial Board, one of such elected representatives shall retire, and the Rector shall take office on the first day of the month immediately following the date of the appointment of the Rector. The elected member to retire shall be decided by lot between the two elected representatives of the Professorial Board.
7 Term of office of representatives of Professorial Board.
(1.)
The term of office of the elected member or members of the Board of Governors representing the Professorial Board shall be three years.
(2.)
The first ordinary election of such member or members shall be held on the first Monday in June, nineteen hundred and twenty-four.
(3.)
Every member elected by the Professorial Board for the ordinary term of office shall take office on the first day of July next following the date of his election.
8 Section 8 of principal Act amended.
Section eight of the principal Act is hereby amended by adding thereto the words “except as a representative of the Professorial Board.”
9 Section 9 of principal Act amended.
Section nine of the principal Act is hereby amended by inserting, after paragraph (4), the following paragraphs:—
“or,
“(5.)
Being a member representing the Professorial Board, ceases to be a member of the Professorial Board; or,
“(6.)
Being the Rector of the College, ceases to hold the office of Rector.”
10 Authority for Board of Governors to expend moneys in celebration of jubilee of College.
The Board of Governors is hereby empowered to expend out of its revenues, during the year ending on the thirty-first day of December, nineteen hundred and twenty-three, such sum or sums as it thinks fit, not exceeding in the aggregate the sum of five hundred pounds, for the purpose of fitly celebrating the fiftieth anniversary of the foundation of the College.
