An Act to amend the Provisions of the Auckland Harbour Board Loan and Empowering Act, 1924, and to enable the Corporation of the City of Auckland (hereinafter called the Corporation) to transfer certain Land to the Auckland Harbour Board (hereinafter called the Board), to alter the Boundary of the City of Auckland, to authorize the Board to enter into an Agreement with the Corporation for the Maintenance of certain Portions of Quay Street West in the said City, and to define the Responsibilities of the Corporation and the Board in connection therewith, and to enable the Transfer by the Board to the Corporation of the Borough of Takapuna of certain Land for the Purposes of Streets and Drainage.
Preamble.
WHEREAS by an Act intituled the Auckland Harbour Board Loan and Empowering Act, 1924 (hereinafter referred to as the said Act), it was enacted, inter alia, that it should be lawful for the Board, out of the moneys borrowed under the said Act, to expend the sum of seven hundred and fifty thousand pounds for the purposes set out in the First Schedule to the said Act: And whereas the Board is desirous that the said sum of seven hundred and fifty thousand pounds, or so much thereof as shall not have been already applied to the said purposes, shall be applied and expended for the purposes set out in the First Schedule hereto in lieu of those set out in the First Schedule to the said Act: And whereas the Corporation has agreed to transfer to the Board that parcel of land described in the Second Schedule hereto, and also to vary the boundaries of the City of Auckland: And whereas the Board is desirous of entering into an agreement with the Corporation as to the maintenance of portions of Quay Street West in the City of Auckland, and defining the responsibilities of the Board and Corporation in connection therewith: And whereas the Board is desirous of transferring to the Corporation of the Borough of Takapuna the parcels of land described in the Fourth Schedule hereto for the purposes of public streets and for drainage, and it is desired to obtain authority for such transfers:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title.
This Act may be cited as the Auckland Harbour Board Empowering Act, 1926.
2 First Schedule to Auckland Harbour Board Loan and Empowering Act, 1924, amended.
The First Schedule to the Auckland Harbour Board Loan and Empowering Act, 1924, is hereby repealed, and the First Schedule hereto is hereby substituted therefor, and the said Act shall hereafter be read and construed as if the First Schedule hereto were the First Schedule to the said Act.
3 Closing portion of a street.
The portion of a street situated in the City of Auckland and described in the Second Schedule hereto is hereby stopped.
4 Corporation authorized to convey land to Harbour Board.
The Corporation of the City of Auckland is hereby authorized to convey to the Board that piece of land described in the Second Schedule hereto.
5 Boundaries of City of Auckland amended.
The boundaries of the City of Auckland shall, as from the date of the passing of this Act, be altered so as to exclude therefrom the piece of land described in the Third Schedule hereto, which shall henceforth be deemed to be included within the boundaries of the Auckland Harbour.
6 Board and Corporation authorized to enter into an agreement for maintenance of portion of Quay Street, and for other matters arising out of construction of a railway thereon.
The Board is hereby authorized to enter into such agreement with the Corporation as the parties may determine for the maintenance of such portions of Quay Street West along which the railway passes, and as to the respective responsibilities for accidents and injuries caused by or arising out of the construction of or existence of the railway, or of the repair or want of repair of the portion of the street over which the railway passes, or any adjoining portion which the Board may agree to keep in repair:
Provided that nothing contained in any such agreement shall impose upon the Board any greater responsibility to any member of the public than would apply to the Corporation.
7 Harbour Board authorized to transfer to Borough of Takapuna lands for certain specified purposes.
It shall be lawful for the Board to transfer to the Corporation of the Borough of Takapuna the parcels of land described in the Fourth Schedule hereto, to be held by the said Corporation for the purposes of public streets, and for the deposit of spoil from the tunnel being excavated in connection with its drainage and sewerage scheme, and thereafter for the erection of certain works in connection with such scheme.
8 Trustees of a savings-bank may lend to the Board.
It shall be lawful for the trustees of any savings - bank established under the Savings-bank Act, 1908, to lend to the Board in terms of the Auckland Harbour Board Loan and Empowering Act, 1924, the sum of fifty thousand pounds.

As the same are shown coloured red on plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 6214.
SECOND SCHEDULE
All that parcel of land, containing 13 perches, more or less, in the City of Auckland, commencing at a point distant in a south-westerly direction in a line bearing 198° 8′, 722·42 links from the north-western corner of King’s Wharf approach; thence in a south-westerly direction in a line bearing 254° 58′, 135·63 links; thence again in a south-westerly direction in a line bearing 198° 26′ 30″, 34·12 links; thence in a south-easterly direction in a line bearing 108° 26′ 30″, a distance of 113·63 links; thence in a north-easterly direction, 108·87 links, to the commencing-point; and being the parcel of land shown coloured yellow on the plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 6215.
THIRD SCHEDULE
All that parcel of land partly reclaimed from the Auckland Harbour and part of the said Auckland Harbour, situated in Block VIII, Rangitoto Survey District, commencing at a point on the north side of Quay Street, in the City of Auckland, distant in a northwesterly direction in a line bearing 288° 8′, 181·51 links from the intersection of Quay Street and King’s Wharf approach; thence in a line bearing 56° 36′, 136·13 links; thence in a north-easterly direction in a line bearing 74° 58′, a distance of 116·77 links; thence again in a north-easterly direction in a line bearing 18° 2′ 30″, 795·87 links; thence south-easterly in a line bearing 107° 43′, 109·34 links, to the north-western corner of King’s Wharf approach; thence in a south-westerly direction in a line bearing 198° 8′, a distance of 722·42 links; thence again south-westerly in a line bearing 198° 8′, 108·87 links; thence in a north-westerly direction in a line bearing 288° 26′ 30″, 113·63 links; thence in a south-westerly direction in a line bearing 198° 26′ 30″, 136·36 links, to the intersection of King’s Wharf approach and Quay Street; thence to the commencing-point: as the same is shown coloured green in outline on the plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 6215.
FOURTH SCHEDULE

All those parcels of land containing together 6 acres 1 rood 0·8 perches, more or less, being those parts of the bed of the Auckland Harbour at Shoal Bay shown on a plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 6216.

All that parcel of land containing 3 roods 8 perches, more or less, being that part of the bed of the Auckland Harbour at Shoal Bay shown on a plan deposited in the office of the Marine Department, at Wellington, and marked M.D. 6216.
