An Act to enable the Johnsonville Town District and the County of Makara and the Inhabitants thereof to obtain a Supply of Gas.

Preamble.

WHEREAS it is expedient that the Johnsonville Town District, as constituted under the Town Boards Act, 1908, and the County of Makara, as constituted under the Counties Act, 1920, and the inhabitants thereof should obtain a supply of gas: And whereas such a supply of gas as aforesaid is available from the Wellington Gas Company, Limited: And whereas by the Wellington Gas Company Act, 1870, provision was made for authorizing the Wellington Gas Company, Limited, to supply the City of Wellington and the inhabitants thereof with gas and for other purposes relating thereto, and to the objects for which the said Company had been established:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Johnsonville and Makara Gassupply Act, 1928.

2 Power to the Wellington Gas Company to supply gas to Johnsonville and Makara.

The Wellington Gas Company, Limited, is hereby empowered to extend the area of its operations so as to include not only the City of Wellington, but also the Johnsonville Town District, as constituted under the Town Boards Act, 1908, and the County of Makara, as constituted under the Counties Act, 1920, and to exercise in the said areas the powers and authorities conferred upon the Company by the Wellington Gas Company Act, 1870, with reference to the City of Wellington, and the objects of the Wellington Gas Company, Limited, are hereby extended accordingly.

3 Provisions of the Wellington Gas Company Act, 1870, with reference to the City of Wellington corporated and made applicable to Johnsonville and Makara.

The provisions of the Wellington Gas Company Act, 1870, shall apply not only to the City of Wellington, but also to the Johnsonville Town District and the County of Makara.

With respect to the Johnsonville Town District and the County of Makara, the said Act shall be construed as if the references therein to the City of Wellington and the Town Board thereof were references to the Johnsonville Town District and the Town Board thereof and the County of Makara and the Council thereof respectively, and as if the references therein to streets were references to roads.

4 Purchase of gasworks, &c.

The Johnsonville Town Board and the Makara County Council shall be entitled conjointly, at any time after the expiration of ten years from the passing of this Act, to purchase from the Wellington Gas Company, Limited, any gasworks, mains, lamps, pipes, conduits, and other plant used or employed by the company in the said town district and county. The amount of the purchase-money and the terms of the purchase shall be such as shall be mutually agreed upon, and failing such agreement the same shall be determined by arbitration under and pursuant to the Arbitration Act, 1908.
