An Act to validate the Reclamation by the Lyttelton Harbour Board of certain Land from the Sea, and to vest such Land in the Board.
Preamble.
WHEREAS the Lyttelton Harbour Board (hereinafter referred to as the Board) by the Lyttelton Harbour Reclamation and Empowering Act, 1910, was empowered from time to time to fill up and reclaim from the sea certain lands described in the Schedule to that Act, and it was further enacted that the land described in the Schedule to that Act should vest in the Board for the purposes for which the Board was constituted: And whereas in the process of effecting such reclamation the Board has filled up and reclaimed from the sea the further land, containing two acres three roods thirty perches, described in the Schedule hereto, adjoining the land which it was empowered to reclaim by the Lyttelton Harbour Board Reclamation and Empowering Act, 1910, and the Board is desirous that such filling-up and reclamation should be validated and that the said land should be vested in the Board:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Lyttelton Harbour Board Reclamation Validation Act, 1929.
2 Interpretation.
In the construction of this Act, if not inconsistent with the context,—
“The Act” means and includes the Harbours Act, 1923, and its amendments:
“Board” means the Lyttelton Harbour Board as constituted under the Harbours Act, 1923, and its amendments.
3 Special Act.
This Act shall be deemed to be a special Act within the meaning of the Act.
4 Validation of reclamation.
The filling-up and reclamation by the Board of the land described in the Schedule hereto is hereby validated.
5 Vesting land in Board.
From and after the passing of this Act the land described in the Schedule hereto is hereby vested in the Board and its successors for an estate of inheritance in fee-simple for the purposes for which the Board is constituted, and the District Land Registrar of the Canterbury Land Registration District shall, on the application of the Board, issue a certificate of title for the said land to the Board.
6 Lyttelton Harbour Board Reclamation and Empowering Act, 1910, and the Lyttelton Harbour Board Land Act, 1913, to apply.
All the provisions of the Lyttelton Harbour Board Reclamation and Empowering Act, 1910, and the Lyttelton Harbour Board Land Act, 1913, shall apply to the land in the Schedule hereto as fully and effectually in all respects as if the land described in the Schedule hereto had originally formed part of the area described in the Schedule to the Lyttelton Harbour Board Reclamation and Empowering Act 1910.
Schedule
All that area, originally situated in the Lyttelton Harbour, containing 2 acres 3 roods 30 perches, more or less, and bounded as follows: commencing at a point on the southern boundary of Lot 1 on the plan deposited in the office of the District Land Registrar at Christchurch as No. 8045, the said point bearing 217° 18′ 20’ south-westerly from Mount Pleasant Geodesical Station and being distant therefrom 15067 links; thence south-easterly and bearing 106° a distance of 240·6 links; thence south-easterly and bearing 98° a distance of 600 links; thence south-easterly and bearing 92° 30′ a distance of 610 links; thence north-easterly and bearing 88° a distance of 514 links; thence generally south-westerly, westerly, and north-westerly along high-water mark along the outside edge of the retaining-wall as shown on the said Deposited Plan No. 8045 to the commencing-point: as the boundaries of the said area of 2 acres 3 roods 30 perches are shown margined red on the plan marked M.D. 6545, deposited in the office of the Marine Department at Wellington, in the Provincial District of Wellington.
