An Act to empower the Clutha River Board to purchase a Motor Lorry or Lorries and to operate the same and to borrow certain Moneys.
Preamble.
WHEREAS the Clutha River Board (hereinafter termed the said Board) has a steamboat which it is empowered to use on the Clutha River for clearing and keeping open for traffic the navigable waters of the Clutha River, for carrying out all work which the Board is empowered to carry out, and for the carriage of passengers and goods on the said river at such times and on such terms as the Board may decide: And whereas the said Board was empowered by the Clutha River Board Empowering Act, 1923, to raise a special loan of ten thousand pounds, and to apply the proceeds of the sale or hypothecation of the debentures of such loan in repayment of the Board’s overdraft and in improving the navigability of the Clutha River: And whereas the said Board has sold some of the said debentures and the remainder are subject to a deed of hypothecation in favour of the Board’s bankers: And whereas it is desirable to empower the Board to purchase a motor-lorry or motor-lorries and to operate the same in conjunction with the steamboat service now being operated by the said Board:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Clutha River Board Empowering Act, 1930.
2 Authority to purchase motor lorry or lorries.
The said Board is hereby empowered to purchase a motor-lorry or motor-lorries.
3 Power to operate lorry or lorries.
The said Board is hereby empowered to operate such motor-lorry or motor-lorries for the purpose of delivering goods from or to its steamboat or (when it is inconvenient, impracticable, or uneconomical to run its steamboat) from or to Balclutha, Waiwera, or any other place within the Board’s district.
4 Borrowing-powers.
(1)
The said Board may borrow moneys for the purpose of paying for the said motor-lorry or motor-lorries by the sale of unsold debentures of the said loan, by further advances from its bankers upon the security of the deed of hypothecation hereinbefore referred to, or by the further hypothecation of the said unsold debentures.
(2)
The authority to borrow conferred by the last preceding subsection shall be exercised subject to the provisions of the Local Government Loans Board Act, 1926, in all respects as if it were an authority to raise a new loan.
5 Power to hire lorries.
In addition to the powers hereinbefore conferred upon it, the said Board is hereby further empowered from time to time to hire motor-lorries for the purposes aforesaid.
6 Saving as to existing securities.
Nothing herein contained shall prejudice any existing security held by the said Board’s bankers.
7 Power to pay costs.
The said Board is hereby empowered to pay the costs incurred by the Board in promoting this Act.
8 Act of 1898 amended.
Section nineteen of the Clutha River Board Empowering Act, 1898, is hereby amended by inserting, after the word “steamer”
, the following words: “or by such other means of conveyance as may from time to time be adopted by the Board”
.
9 Repeal.
Section forty-nine of the Local Legislation Act, 1929, is hereby repealed.
