An Act to enable the Bay of Plenty Licensing Committee to order the Removal of certain Licenses on account of the Diversion of Principal Highways in its District.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Bay of Plenty Licensing Committee Enabling Act, 1933.
2 Committee may order removal of accommodation licenses beyond limits fixed by section 127 of Licensing Act, 1908, in certain cases.
Notwithstanding anything contained in subsection four of section one hundred and twenty-seven of the Licensing Act, 1908, where the principal public highway between any two localities in its district has heretofore been diverted, the Bay of Plenty Licensing Committee may, under section one hundred and twenty-nine of that Act, order the removal to any premises situated on or conveniently near to such highway as so diverted of any publican’s license or accommodation license held in respect of licensed premises which by reason of such diversion are no longer situated on or near such highway, if the said Committee is satisfied that serious inconvenience will be caused to persons travelling between such localities if such removal is not ordered.
