An Act empowering the Oamaru Harbour Board to construct an Extension to the existing Breakwater at the Port of Oamaru and to carry out other Works incidental to the Improvement of the Harbour of the Port of Oamaru.
Preamble.
WHEREAS the Oamaru Harbour Board (hereinafter called the Board) was originally constituted as a corporate body by virtue of an Ordinance of the Superintendent and Provincial Council of the Province of Otago, shortly intituled the Oamaru Harbour Board Ordinance, 1874: And whereas by section thirty-three of the said Ordinance the Board was empowered to construct such breakwaters, docks, quays, wharves, piers, and jetties as should by the Board be considered to be necessary for the purposes of the said Ordinance and also, inter alia, such other works as by the Board should be judged necessary for the safety, convenience, or reception of ships and vessels resorting to the harbour of the Port of Oamaru or for the safety or protection of any works constructed or proposed to be constructed by the said Board: And whereas under the authority of the said Ordinance a breakwater and other works were constructed by the Board within the Port of Oamaru: And whereas it has now been found that the said breakwater and other works are insufficient for the safety, convenience, and reception of ships or vessels resorting to the said Harbour: And whereas as part of the scheme for the harbour improvements the Board proposes to construct an extension to the said breakwater: And whereas doubts have arisen as to whether the Board is by law empowered to construct the said extension and it is desirable that such doubts should be removed:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Oamaru Harbour Board Empowering Act, 1934.
2 Authority to extend existing breakwater.
Notwithstanding anything contained in subsection three of section one hundred and sixty-eight of the Harbours Act, 1923, it shall be lawful for the Board, with the sanction of the Governor-General in Council first had and obtained in the manner provided by section one hundred and seventy-one of that Act, to construct an extension to the existing breakwater in the harbour of the Port of Oamaru, and for that purpose to make, erect, or construct any structure in, on, over, through, or across the tidal lands or the tidal waters, or in or upon any part of the bottom or bed of the said harbour.
3 Act to be a special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923.
