An Act to remove Doubts as to the Due Constitution and Boundaries of certain Water-race Districts in the County of Featherston, and as to the Constitution and Course of the Water-races within the said Districts.
Preamble.
WHEREAS doubts have arisen as to the due constitution of certain Water-race Districts in the County of Featherston—namely, the Moroa Water-race District, the Dry River Water-race District, and the Featherston-Longwood Water-race District—and as to the boundaries of the said districts and the position and legality of channels used as water-races within the said districts: And whereas it is desirable that such doubts should be removed:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Featherston County Water-race Districts Validation Act, 1935.
2 Declaring Dry River Water- race District, vesting races, and declaring plan to be a map under section 31. Water-supply Act, 1908.
(1)
The Dry River Water-race District shall comprise all the lands described in the First Schedule hereto, and the said lands are hereby declared to be a Water-race District within the meaning of the Water-supply Act, 1908.
(2)
Every water-race shown on the plan referred to in the said Schedule is hereby declared to be a water-race within the meaning of the Water-supply Act, 1908, and to be vested in the Corporation of the County of Featherston subject to all the rights, powers, agreements, obligations, and liabilities attaching thereto or affecting the same.
(3)
The said plan shall for all purposes be deemed to be a map of the said district, and races made under the authority of and subject to the terms of section thirty-one of the Water-supply Act, 1908.
3 Declaring Moroa Water-race District, vesting races, and declaring plan to be a map under section 31, Water-supply Act, 1908.
(1)
The Moroa Water-race District shall comprise all the lands described in the Second Schedule hereto, and the said lands are hereby declared to be a Water-race District within the meaning of the Water-supply Act, 1908.
(2)
Every water-race shown on the plan referred to in the said Schedule is hereby declared to be a water-race within the meaning of the Water-supply Act, 1908, and to be vested in the Corporation of the County of Featherston subject to all the rights, powers, agreements, obligations, and liabilities attaching thereto or affecting the same.
(3)
The said plan shall for all purposes be deemed to be a map of the said district and races made under the authority of and subject to the terms of section thirty-one of the Water-supply Act, 1908.
4 Declaring Featherston-Longwood Water-race District, vesting races, and declaring plan to be a map under section 31, Water-supply Act, 1908.

The Featherston-Longwood Water-race District shall comprise all the lands described in the Third Schedule hereto, and the said lands are hereby declared to be a Water-race District within the meaning of the Water-supply Act, 1908.
(2)
Every water-race shown on the plan referred to in the said Schedule is hereby declared to be a water-race within the meaning of the Water-supply Act, 1908, and to be vested in the Corporation of the County of Featherston subject to all the rights, powers, agreements, obligations, and liabilities attaching thereto or affecting the same.
(3)
The said plan shall for all purposes be deemed to be a map of the said district and races made under the authority of and subject to the terms of section thirty-one of the Water-supply Act, 1908.
5 Saving.
All offices, appointments, licenses, regulations, rules, by-laws, Proclamations, Orders in Council, special orders, Warrants, registers, resolutions, rolls, petitions, polls, titles, rates, scales, records, instruments, and generally all acts of authority which originated under the Water-supply Act, 1908, or its amendments, or under any of the enactments of which that Act is a consolidation, or any Act thereby repealed and which purported to be made, issued, passed, or executed on account of, in connection with, or relating to the Dry River Water-race District, the Moroa Water-race District, or the Featherston-Longwood Water-race District shall enure for the purposes of the said districts respectively as hereby constituted as fully and effectually as if they had been so made, issued, passed, or executed on account of, in connection with, or relating to the said districts respectively as hereby constituted.
SCHEDULES
FIRST SCHEDULE Dry River Water-race District
All that area in the Wellington Land District situated in Block XIII, Huangarua Survey District, and Block XVI, Wairarapa Survey District, bounded by a line commencing at a point on the western boundary of the Martinborough–Awhea Road at its intersection with the eastern boundary of the Lower Valley Road, and proceeding from this intersection-point in a south-easterly direction along the said western boundary of the Awhea Road; crossing the Wharekaka Road and continuing along the said boundary of the Awhea Road to the westernmost point of Section 23, Block XIII, Huangarua Survey District; proceeding in a south-easterly direction along the western and southern boundary-lines of the said Section 23 to the western boundary of the said Awhea Road; proceeding again in a south-easterly direction along the western boundary of the said Awhea Road to its intersection with the south-eastern boundary-line of Section 32, Wharekaka Block; proceeding in a south-westerly direction along the said south-eastern boundary-line of Section 32 to its intersection with the south-western boundary-line of Lot 8, Dyer Settlement; proceeding in a south-easterly direction along the said south-western boundary of Lot 8 for a distance of 7 chains; thence proceeding in a south-westerly direction by a line parallel to the south-eastern boundary-line of Section 32, Wharekaka Block, to the south-western boundary-line of Lot 9, Dyer Settlement; thence proceeding in a north-westerly direction along the said south-western boundary-line of Lot 9 to its intersection with the south-eastern boundary-line of Section 32, Wharekaka Block; thence proceeding in a south-westerly direction along the said south-eastern boundary of Section 32 to the southernmost point of the said Section 32; thence proceeding in a south-easterly direction along the north-east boundary-line of Section 11, Wharekaka Block, to the easternmost corner of the said Section 11; thence proceeding in a south-westerly direction along the south-east boundary of the said Section 11, crossing the Dry River Road, and proceeding to the northern bank of Dry River at its intersection with the said south-east boundary-line of Section 11; thence proceeding generally in a north-westerly direction by the northern bank of the Dry River along the riverside boundary-lines of part Lot 14, and Lot 13, Dyer Settlement, as shown on Survey Office Plan 8/20, and along the riverside boundary-line of part Lot 7b, Dyer Settlement, as shown on Survey Office Plan 7/34, both plans being deposited in the office of the Survey Department at Wellington, to the intersection of the said northern bank of the Dry River and the eastern boundary-line of the Lower Valley Road; from this point proceeding in a north-easterly direction along the south-eastern boundary of the Lower Valley Road to the westernmost corner of Section 26, Block XVI, Wairarapa Survey District; proceeding in a south-easterly direction along the south-western boundary-line of the said Section 26 to the southernmost corner of the said Section 26; thence proceeding in a north-easterly direction along the south-eastern boundary-line of the said Section 26, crossing the Dry River Road to and along the south-eastern boundary-lines of Section 25, Block XIII, Huangarua Survey District; and Lot 6a, Dyer Settlement, to the easternmost corner of the said Lot 6a; thence proceeding in a north-westerly direction along the north-eastern boundary-line of the said Lot 6a to the south-eastern boundary of the Lower Valley Road; proceeding thence by a straight line intersecting Lot 7, Dyer Settlement, to a point on the north-eastern boundary of the said Lot 7 at a distance of 24 chains from the north-western boundary of the Lower Valley Road; thence proceeding in a north-easterly direction by a straight line parallel to the Lower Valley Road intersecting Lot 6, Dyer Settlement, to the north-eastern boundary of the said Lot 6; thence proceeding in a south-easterly direction along the north-eastern boundary-line of the said Lot 6 and the projection thereof to and across the Lower Valley Road to the north-western boundary-line of Lot 3, Dyer Settlement; thence proceeding in a north-easterly direction along the eastern boundary of the Lower Valley Road to the intersection with the western boundary of the Martinborough–Awhea Road, the point of commencement: As the said area is shown outlined in red on a plan deposited at the offices of the Featherston County Council, Kitchener Street, Martinborough, marked “Plan of the Dry River Water-race District,”
and sealed with the seal of the Chairman, Councillors, and Inhabitants of the County of Featherston on the 12th day of July, 1935, pursuant to a resolution passed by the Featherston County Council on the 12th day of July, 1935.
SECOND SCHEDULE Moroa Water-race District
All that area in the Wellington Land District situated in Block IX, Waiohine Survey District, Block XIII, Tiffin Survey District, Blocks I and V, Huangarua Survey District, and Blocks IV and VIII, Wairarapa Survey District, bounded by a line commencing at a point in the middle of the Tauherenikau Road in line with the production of the south-west boundary-line of Section 38, Moroa Block; thence towards the north-east by a line along the middle of the Tauherenikau Road to a point in line with the north-east boundary-line of Section 54, Moroa Block; thence in a south-east direction to and by the said boundary-line and the production thereof to the middle of the Moroa Road; thence towards the north-east by a line along the middle of the said Moroa Road to its intersection with the middle of Kempton’s Road; again towards the south-east by a line along the middle of Kempton’s Road to a point in line with the south-east boundary-line of Section 73, Greytown Small-farm Settlement;
