An Act to amend the Napier Harbour Board Loan Act, 1933.
Preamble.
WHEREAS by the Napier Harbour Board Loan Act, 1933 (hereinafter called the said Act), the Napier Harbour Board (hereinafter called the Board) was empowered to borrow, in manner and subject as thereby provided, any sum or respective sums of money, not exceeding in the aggregate three hundred and thirty-five thousand seven hundred pounds, and to apply the sums so borrowed in and about the construction and carrying-out of such of the works referred to in the Napier Harbour Board Loan Act, 1884, and the Napier Harbour Board Loan Act, 1892 (in the said Act and hereinafter referred to as the principal Acts), as are more particularly referred to in the First Schedule to the said Act: And whereas the poll of ratepayers required by the said Act to be taken was duly taken and carried, and the Board has been duly empowered thereby, and otherwise as by law required to borrow the sum of three hundred and thirty-five thousand pounds: And whereas part of the said works have been undertaken and the said moneys have been raised: And whereas one of the works specified in the said First Schedule to the said Act is thus described therein—namely, “Construction of one thousand eight hundred feet of western mole, with breastwork,”
and the amount allocated in the said Schedule to this particular work (hereinafter referred to as the said particular work) is the sum of seventy thousand pounds: And whereas no part of the said particular work has been constructed and no part of the said sum of seventy thousand pounds has been expended: And whereas since the passing of the said Act it has been found that the construction of the said particular work is unnecessary as part of the object of the general scheme of works for the carrying-out and construction of which the Board was authorized to raise the said loan, and the Board, acting on the advice of the engineers who were its advisers in designing the original scheme of works and prepared the plans therefor, has decided to abandon the construction of the said particular work as being unnecessary and superfluous, and, acting on the like advice, to devote the sum of seventy thousand pounds allocated as aforesaid to the said particular work, together with the sum of fifty thousand pounds representing the employment subsidy payable in respect of the whole of the said works, to the construction of other necessary works in connection with the general scheme of works (other than the said particular work) contemplated by the said Act, including the construction of an additional wharf (not included in the list of works set out in the First Schedule to the said Act) in concrete instead of in timber:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Napier Harbour Board Loan Amendment Act, 1937.
2 Special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923.
3 Board to abandon a particular work.
The Board shall abandon the construction of the said particular work.
4 Board empowered to divert sum of £70,000.
The Board is hereby authorized and empowered to devote and apply the sum of seventy thousand pounds allocated to the said particular work by the said Act, and all moneys payable to the Board by way of employment subsidy in respect of the said scheme of works and all other moneys by the said Act authorized to be raised, to the construction, execution, and doing of such of the works referred to in the principal Acts as are more particularly specified in the Schedule hereto.
5 Authority for works already commenced.
Any part of the works comprised in the First Schedule to the said Act which have already been commenced pursuant to the powers conferred by the said Act shall be deemed to have been commenced pursuant to the powers conferred by the said Act as amended by this Act.
6 Repeal.
The First Schedule to the said Act is hereby consequentially repealed.
