An Act to authorize the Auckland Harbour Board to borrow the Sum of One Million Pounds for the Purpose of constructing Harbour-works.

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Auckland Harbour Board Loan and Empowering Act, 1937.

2 Special Act.

This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923.

3 Harbour-works authorized.

The Board is hereby authorized, subject to the provisions of the Harbours Act, 1923, to construct and carry out the harbour-works specified in the Schedule hereto.

4 Power to raise £1,000,000.

It shall be lawful for the Board from time to time, as it may require, to borrow, subject to the provisions of the Harbours Act, 1923, and the Local Government Loans Board Act, 1926, a sum or sums of money not exceeding in the aggregate the sum of one million pounds.

5 Expenditure of moneys.

All moneys borrowed under and by the authority of this Act shall be applied and expended in the construction of the harbour-works specified in the Schedule hereto:

Provided that in the event of the Board expending any moneys from the Harbour Fund of the Board on any such harbour-works before the raising of any of the moneys authorized to be borrowed by this Act, then and in such case the Board is authorized to refund to the Harbour Fund from the moneys borrowed under the authority of this Act the amount of any moneys so expended after the first day of October, nineteen hundred and thirty-seven, and any amount so refunded shall be deemed to have been applied and expended on such harbour-works.

Schedule

Export wharf, with buildings and equipment, and breastwork, dredging, roading, and access in connection therewith.

Special wharfage accommodation, with buildings and equipment for passenger and tourist vessels.

Eastern waterfront reclamation and construction of breastworks, and quays in connection therewith.

As the said works are more particularly shown and coloured pink on a plan marked M.D. 7644, and deposited in the office of the Marine Department at Wellington.
