An Act to authorize the Bluff Borough Council to refund certain Rates and to remit Rates accruing in respect of the Bluff Sailors’ Rest.

Preamble.

WHEREAS the Bluff Borough Council is desirous of obtaining authority to refund certain rates, amounting in all to the sum of fifteen pounds five shillings, paid by the trustees of the Bluff Sailors’ Rest to the said Council for the year ended the thirty-first day of March, nineteen hundred and thirty-nine, and to remit the annual rates accruing due for all subsequent years, in respect of that piece of land in the Borough of Bluff containing twenty perches, more or less, being part of the Railway Reserve and known as the “Sailors’ Rest”: And whereas the said Council has no legal authority to make such refund and remissions except out of unauthorized expenditure:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Bluff Borough Empowering Act, 1939.

2 Bluff Borough Council authorized to refund certain rates.

The Bluff Borough Council is hereby authorized to refund to the trustees of the Bluff Sailors’ Rest the said sum of fifteen pounds five shillings.

3 Authorized to remit rates annually on the “Sailors’ Rest” property.

The Council may remit all rates accruing due for the year ending on the thirty-first day of March, nineteen hundred and forty, and for any subsequent years in respect of the said piece of land, being the “Sailors’ Rest,” and in respect of any rates so remitted may absolve the said trustees and the said land from all liability in respect thereof.

4 Limitation of time within which special powers exercisable.

The powers conferred upon the Council under section three hereof shall be exercisable only for so long as trustees of the Bluff Sailors’ Rest shall be the occupiers of the said land and shall use the said land for the purposes of a sailors’ rest.
