An Act to amend the Waiapu County Council (Tokomaru Harbour) Empowering Act, 1910.
Preamble.
WHEREAS by the Waiapu County Council (Tokomaru Harbour) Empowering Act, 1910, the Waiapu County Council (hereinafter called the Council), (exercising the powers of a Harbour Board which were conferred upon it by an Order in Council dated the first day of April, nineteen hundred and eight) was empowered to borrow any sum not exceeding one hundred thousand pounds to be employed in the purchase of certain works and lands and in the construction and carrying out of harbour-works at Tokomaru Bay: And whereas under those powers the Council borrowed in all the sum of forty-five thousand five hundred pounds, which was expended in acquiring and constructing the present harbour-works at Tokomaru Bay, the security for the money so borrowed being a special rate levied on the rating district described and defined by subsection five of section five of the said Act: And whereas the Awanui Riding (as then constituted) of the county was not included in the rating district because of the fact that at the time of the passing of the said Act the area comprising the said Awanui Riding had its own harbour facilities at Port Awanui: And whereas for many years past the harbour facilities at Port Awanui have ceased to exist and Port Awanui is no longer used by shipping as a port: And whereas since the abandonment of Port Awanui as a port the whole of the shipping for the area comprised in the said Awanui Riding has been served by the wharves and shipping sheds at Tokomaru Bay: And whereas it is considered by the Council to be fair and equitable that the said Awanui Riding should now be included in the Waiapu County (Tokomaru Harbour) Rating District:
Be it therefore exacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Waiapu County Council (Tokomaru Harbour) Empowering Amendment Act, 1943, and shall be read together with and deemed part of the Waiapu County Council (Tokomaru Harbour) Empowering Act, 1910 (hereinafter referred to as the principal Act).
2 Harbour rating district extended to include whole County of Waiapu.
The district called the Waiapu County (Tokomaru Harbour) Rating District constituted by subsection five of section five of the principal Act is hereby extended to include the whole of the County of Waiapu as constituted at the passing of this Act.
3 Harbour rating district to be liable for all special harbour rates.
Every special rate which at any time before the passing of this Act has been made and levied by the Council as security for any loan raised by the Council under the authority of the principal Act shall be deemed to have been made and levied in all respects as if the rating district as extended by the provisions of this Act had been the rating district at the time the special rate was made by the Council.
