This Act may be cited as the Christchurch Domains Act, 1946.

The Christchurch Domain Board constituted under the provisions of the Christchurch Domains Amendment Act, 1913, is hereby dissolved, and the lands comprising the Christchurch Domains known as Hagley Park, the Botanic Gardens, and Reserves 4477 and 4478 are hereby added to the Christchurch City and Suburban Domain and shall henceforth be controlled by the Christchurch City Council acting as the Christchurch City and Suburban Domain Board under and subject to the provisions of Part II of the Public Reserves, Domains, and National Parks Act, 1928:

Provided that the Botanic Gardens shall be administered, maintained, and kept by the Christchurch City and Suburban Domain Board as a botanic garden and for that purpose alone:

Provided also that that portion of Hagley Park now occupied by the Magnetic Observatory shall not, so long as it is so occupied, be under the control of the said Christchurch City and Suburban Domain Board.

All property of the Christchurch Domain Board existing at the date of the passing of this Act shall vest in the Christchurch City and Suburban Domain Board, which shall make all arrangements necessary to satisfy all the obligations, financial or otherwise, of the said Christchurch Domain Board.

The Christchurch Domains Act, 1904, the Christchurch Domains Amendment Act, 1913, section eighty-one of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1917, section fifty-one of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1925, section twenty-eight of the Reserves and other Lands Disposal Act, 1926, the Christchurch Domains Amendment Act, 1937, and the Christchurch Domains Amendment Act, 1943, are hereby repealed.

All regulations, by-laws, offices, and appointments constituted or made under the Acts referred to in the last preceding section and subsisting at the commencement of this Act shall be deemed to have been made or constituted under this Act, and shall have effect accordingly.
