An Act to extend the Provisions of the New Plymouth Borough Council and New Plymouth Harbour Board Empowering Act, 1933.
Preamble.
WHEREAS section five of the New Plymouth Borough Council and New Plymouth Harbour Board Empowering Act, 1933, empowers the New Plymouth Harbour Board (hereinafter referred to as the Board) to grant licences for specified purposes in respect of certain land of the Board as in the said Act described, and to permit the New Plymouth Borough Council (hereinafter referred to as the Council) to control the use of the said land by the public, confers incidental powers on the Council, and makes by-laws of the Council apply to the said land: And whereas it is expedient that the powers and authorities of the Board and the Council should be extended to additional land of the Board as hereinafter appears:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the New Plymouth Borough Council and New Plymouth Harbour Board Empowering Amendment Act, 1948, and shall be read together with and deemed part of the New Plymouth Borough Council and New Plymouth Harbour Board Empowering Act, 1933 (hereinafter referred to as the principal Act).
2 Certain powers and authorities under principal Act extended to other land.
(1)
The provisions of section five of the principal Act and the powers and authorities therein contained shall extend to and be applicable in respect of the land of the Board described in the Schedule to this Act.
(2)
Notwithstanding anything to the contrary in the principal Act or in this Act, it shall not be lawful for the Council to exercise in respect of the lands referred to in section five of the principal Act or in this Act the powers conferred by section three hundred and nine of the Municipal Corporations Act, 1933.
(3)
Subject to the provisions of subsection two of this section, the powers and authorities conferred by this section are in addition to and not in substitution for the powers and authorities conferred by the said section five of the principal Act.
Schedule
All that parcel of land containing approximately 4 acres 1 rood 30.55 perches, situate immediately west of the Hongi Hongi Stream, in the Borough of New Plymouth, being parts of Harbour Reserves A and L in Block IV, Paritutu Survey District, being more particularly delineated upon the plan marked M.D. 8727 deposited in the office of the Marine-Department at Wellington and thereon edged pink.
