An Act to amend the Auckland Community Welfare Centre and Auckland City Empowering Act, 1941.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Auckland Community Welfare Centre and Auckland City Empowering Amendment Act, 1948, and shall be read with and form part of the Auckland Community Welfare Centre and Auckland City Empowering Act, 1941 (herein termed the principal Act).
2 Section 18 of principal Act (function of Board) amended.
Subsection one of section eighteen of the principal Act is hereby amended by omitting therefrom the words “the land described in the Schedule hereto”
, and substituting therefor the words “such land as may be acquired by the Board for the purposes of this Act”
.
3 Section 19 of principal Act (power of Auckland City Council to transfer certain land) and the Schedule to the principal Act repealed.
Section nineteen of the principal Act and the Schedule to the principal Act are hereby repealed.
4 Power to Board to take and acquire land under the Public Works Act, 1928.
The Board is hereby empowered to take and acquire, under the provisions of the Public Works Act, 1928, such land as it may require for the purposes of its primary function in all respects as though the Board were a local authority within the meaning of that Act, and to the extent hereby authorized the provisions of that Act shall extend and apply to the Board. The provision of a community welfare centre shall be deemed to be a public work within the meaning of the said Act.
5 Compensation for lands taken.
Every person having any estate or interest in any lands taken under the authority of this Act or injuriously affected thereby shall be entitled to full compensation for the same from the Board. Such compensation may be claimed and shall be determined in the manner provided by the Public Works Act, 1928.
6 Section 20 of principal Act (power of Board to establish Auckland Community Welfare Centre) amended.
Section twenty of the principal Act is hereby amended by omitting therefrom the words “the land referred to in the last preceding section”
, and substituting therefor “such land as may be acquired by it for the purposes of this Act”
.
7 Section 21 of principal Act (general powers of Board) amended.

Paragraph (h) of section twenty-one of the principal Act is hereby amended by omitting therefrom the words “except the land described in the Schedule hereto and any building erected thereon”
.

Paragraph (f) of section twenty-one of the principal Act is hereby amended by omitting therefrom the proviso to the said paragraph.
(3)
Paragraph (l) of section twenty-one of the principal Act is hereby amended by omitting therefrom the proviso to the said paragraph.
8 Section 24 of principal Act (exemption from rates) amended.
Section twenty-four of the principal Act is hereby amended by omitting therefrom the words “described in the Schedule hereto”
, and substituting therefor the words “on which the Board shall for the time being provide and maintain a community welfare centre”
.
