An Act to Enable the Balclutha Borough Council to Dispose of a Parcel of Land Situate in the Town of Balclutha.

Preamble.

WHEREAS the Corporation of the Mayor, Councillors, and Burgesses of the Borough of Balclutha is registered as the proprietor of an estate in fee-simple in the land described in the Schedule to this Act: And whereas the said land is held as an endowment in aid of the borough funds: And whereas it is desirable for the development of the Borough of Balclutha and for the benefit of the citizens thereof that the Council of the said borough should have power to dispose of the said lands and to utilize the moneys derived from such disposal in purchasing lands required for street-widening purposes in the said borough:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—

1 Short Title.

This Act may be cited as the Balclutha Borough Council Empowering Act, 1949.

2 Power to sell endowment land.

Notwithstanding anything to the contrary in the Public Reserves, Domains, and National Parks Act, 1928, or any other Act, the Balclutha Borough Council is hereby empowered to sell, by private contract or otherwise, the land described in the Schedule to this Act, freed and discharged from the trusts, reservations, and restrictions affecting the said land.

3 Application of proceeds of sale.

The Council shall on the sale of the said land utilize the net proceeds derived from the sale of the said land in the purchase for street-widening purposes of other land in the borough.

Schedule

All that area in the Borough of Balclutha, Otago Land District, containing 3 roods and 18·98 perches, more or less, being Lot 2 on a plan deposited in the Land Registry Office at Dunedin under Number 6351, and being Part Section 6, Block XXVII, Town of Balclutha, and being part of the land comprised and described in certificate of title, Volume 327, folio 133, Otago Registry.

Also all that area in the Borough of Balclutha, Otago Land District, containing 2 acres and 30 perches, more or less, being Section 7, Block XXVII, Town of Balclutha, and being the balance of the land comprised and described in certificate of title, Volume 75, folio 182, Otago Registry.
