An Act to Vest in the Whangarei Harbour Board Certain Lands in the Land District of North Auckland and to Authorize the Whangarei Harbour Board to Reclaim the said Lands and to Borrow the Sum of Five Hundred and Ninety-three Thousand Pounds for the Purpose of Reclaiming Part of the said Lands and for Other Harbour Works.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whangarei Harbour Board Vesting and Empowering Act, 1950.
2 Interpretation.
In this Act, if not inconsistent with the context,—
“Board” means the Whangarei Harbour Board: “District”
means the Whangarei Harbour Board District.
3 Special Act.
This Act shall be deemed to be a special Act within the meaning of the Harbours Act, 1923.
4 Vesting lands in Board.
(1)
The lands described in the First Schedule to this Act are hereby vested in the Board for an estate in fee simple.
(2)
The District Land Registrar for the Land Registration District of Auckland is hereby authorized and directed, on the deposit with him of a plan of the said lands, to issue to the Board a certificate of title in respect of the said lands, and to make such entries in the register-books and do all such things as may be necessary to give effect to the provisions of this section.
5 Reclamation authorized.
The Board is hereby authorized, subject to the provisions of the Harbours Act, 1923, to reclaim tidal lands in the Whangarei Harbour, being the land described in the First Schedule hereto.
6 Power to borrow.
(1)
It shall be lawful for the Board, subject to the provisions of the Harbours Act, 1923. and the Local Government Loans Board Act, 1926, from time to time to borrow in accordance with Part I of the Local Bodies’ Loans Act, 1926, a sum or sums not exceeding in the whole the sum of five hundred and ninety-three thousand pounds (in addition to any moneys heretofore authorized to be borrowed by the Board under or by virtue of any other Act) for the purpose of carrying out the works specified in the Second Schedule hereto.
(2)
The provisions of the Local Bodies’ Loans Act, 1926, shall apply as if the Board was a local authority and the said Harbour works were public works within the meaning of that Act.
7 Board may make special rate.
In addition to the charge on the Harbour Fund created by the Harbours Act, 1923, the Board may make and levy as further security for the moneys authorized to be borrowed by this Act a special rate or special rates not exceeding in all three pence and one farthing in the pound (unimproved value) in the year on all rateable property in the district.
SCHEDULES
FIRST SCHEDULE
All that parcel of land situated in Block XIII, Whangarei Survey District, containing by admeasurement 458 acres 2 roods, more or less, being land below mean high-water mark, Whangarei Harbour, bounded, commencing at a point, being the southern corner of Lot 4 on Land Transfer Plan 26587; thence generally in a north-easterly and northerly direction along the eastern boundary of the aforesaid Lot 4 to the north-eastern corner of the said Lot 4; thence generally in a northerly and easterly direction along the eastern and southern boundary of Lot 2 on Land Transfer Plan 26588 to the south-eastern corner of the aforesaid Lot 2; thence in a southerly direction by a line bearing 179° 13′ 30″ for a distance of 7294–9 links; thence in a westerly direction to the point of commencement by a line bearing 273° 39′ 40″ for a distance of 7990·5 links; as the same is more particularly delineated on the plan marked M.D. 9062, deposited in the Head Office, Marine Department, at Wellington, and thereon edged red. Auckland S.O. plan 36037.
SECOND SCHEDULE
1.
Dredging—
(a)
A channel 300 feet wide to a depth of 22 feet to the proposed new Wharf at Kioreroa:
(b)
A swinging basin 800 feet wide to a depth of 26 feet.
2.
The repair and strengthening of the existing wharf at Kioreroa.
3.
The provision of a reinforced concrete wharf with two railway sidings, goods sheds, and amenities block.
4.
The provision of navigation beacons and lights.
5.
Reclamation.
