An Act to Amend the Whakatane Harbour Act, 1921–22.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Whakatane Harbour Amendment Act, 1950, and shall form part of and be read together with the Whakatane Harbour Act, 1921–22 (hereinafter referred to as the principal Act).
2 Whakatane Harbour District extended.
The Whakatane Harbour District constituted by the principal Act, as described in the First Schedule to the Whakatane Harbour Amendment Act, 1928, is hereby extended to include the areas described in the Schedule to this Act.
3 Taneatua Subdivision consequentially extended.
The areas described in the Schedule to this Act are hereby added to and shall be deemed to form part of the Taneatua Subdivision of the said district, as described in the Second Schedule to the Whakatane Harbour Amendment Act, 1928.
Schedule Areas Added to the Whaktane Harbour District
ALL that area of approximately 2,600 acres in the South Auckland Land District, situated in Blocks II, III, V, VI, and VII, Whakatane Survey District, being that part of the County of Whakatane, bounded by a line commencing at the north-western corner of Lot 140, as shown on the plan numbered 11193, deposited in the Auckland Land Registry Office, being part of Allotment 246a, No. 2, of the Parish of Waimana, and running easterly generally along the shore of the Bay of Plenty to the eastern extremity of Ohope Land Spit; thence south-westerly generally along the line of mean high-water on the northern and western shores of the Ohiwa Harbour to and along the generally northern and eastern sides of Wainui Road to the northern boundary of that part of Lot 2, to the north-west of the aforesaid Wainui Road, as shown on the plan numbered 12843, deposited as aforesaid, being part of Allotment 245, of the Parish of Waimana aforesaid; thence westerly generally along the said northern boundary and along a right line, being the last-mentioned boundary produced, across the said Wainui Road to its western side; thence north-westerly generally along the generally south-western side of Wainui Road aforesaid, along a right line across the aforesaid Road, to and north-easterly generally along the north-western side of Ohope Road, to and along the south-western boundary of Lot 140 aforesaid to its north-western corner, being the point of commencement:
Also all that area of approximately 112 acres in the South Auckland Land District, situated in Blocks III and VI, Whakatane Survey District, being that part of the County of Whakatane known as Ohakana Island, and being Allotment 249 of the Parish of Waimana:
As the said areas are shown on the plan marked M.D. 9059, deposited in the office of the Marine Department at Wellington, and thereon edged red.
