An Act to authorise the Motueka Borough Council to reclaim certain tidal lands in the Borough of Motueka
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Motueka Borough Council Empowering Act 1963.
2 Interpretation
In this Act, unless the context otherwise requires, the term “Corporation”
means the Mayor, Councillors, and Citizens of the Borough of Motueka.
3 Special Act
This Act shall be deemed to be a special Act within the meaning of the Harbours Act 1950.
4 Authority to reclaim land
The Corporation is hereby authorised, notwithstanding anything in section 175 of the Harbours Act 1950, but subject to the provisions of sections 176 to 182 of that Act, to reclaim thirty-two acres and thirty perches, more or less, of tidal lands in the Borough of Motueka, being part of Lot 1 on Deposited Plan 5073, and being part of Sections 146 and 147 (both Maori Reserve) of the Motueka District, being part of the land comprised in memorandum of lease, registered number 60405, from the Maori Trustee as lessor to the Corporation as lessee, and being part of the land comprised in certificate of title, Volume 127, folio 94, Nelson Registry; as the same is more particularly delineated on the plan marked M.D. 11531, deposited in the office of the Marine Department, Wellington, and thereon coloured yellow (S.O. Plan 10347).
