An Act to apply the Urban Farm Land Rating Act 1932 to a certain portion of the County of Manukau
WHEREAS pursuant to section 43 of the Rating Act 1925 all rates made and levied by the Manukau County Council in the County of Manukau from and after the thirty-first day of March, nineteen hundred and sixty-three, shall be made and levied on the unimproved value under the said Act: And whereas in the opinion of the Manukau County Council the rates made and levied in the manner aforesaid on certain farm lands in the said county may be excessive or unduly burdensome because of the rateable value thereof within the meaning of the Rating Act 1925: And whereas it is expedient and therefore desirable that the said Council be empowered to reduce the rateable values of the said lands for the purpose of making and levying rates over the whole county:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title and commencement

This Act may be cited as the Manukau County Urban Farm Land Rating Act 1963.
(2)
This Act shall be deemed to have come into force on the first day of April, nineteen hundred and sixty-three.
2 Urban Farm Land Rating Act 1932 to apply to certain portion of the County of Manukau
(1)
The Urban Farm Land Rating Act 1932 shall, as far as it is applicable and with the necessary modifications, apply with respect to urban farm land situated within that portion of the County of Manukau described in the Schedule to this Act, as if—
(a)
References in that Act to a borough were references to that portion of the County of Manukau described in the Schedule to this Act:
(b)
References in that Act to a Borough Council were references to the Manukau County Council: and
(c)
References in that Act to the Town Clerk were references to the County Clerk of the County of Manukau.
(2)
No person who is a member of any county town committee appointed pursuant to Part XXX of the Counties Act 1956 shall be appointed a member of any Assessment Court established under the Urban Farm Land Rating Act 1932 for that portion of the County of Manukau described in the Schedule to this Act.
(3)
Notwithstanding the provisions of sections 3 and 17 of the Urban Farm Land Rating Act 1932, the Manukau County Council shall forthwith cause a farm land list to be made out for the portion of the County of Manukau described in the Schedule to this Act in the manner prescribed by section 4 of the Urban Farm Land Rating Act 1932; and any farm land roll made in pursuance of such farm land list shall be deemed to have come into force on the first day of April, nineteen hundred and sixty-three.
3 Costs of promoting Act
The costs of promoting this Act, and of all matters preparatory and incidental thereto, shall be paid out of the Manukau County Fund.
Schedule
Section 2
All that area in the North Auckland Land District bounded by a line commencing at a point in the middle of the North Island Main Trunk Railway in line with the northern side of Portage Road in Block VI, Otahuhu Survey District and proceeding easterly along a right line to and along the said roadside to and along the line of mean high water of the southern bank of the Otahuhu Greek and southerly along the western bank of the Tamaki River to the eastern side of the aforesaid railway; thence southerly along that side to the eastern bank of the Tamaki River and generally northerly along the line of mean high water of the generally eastern bank of the said river to Musick Point; thence south-easterly generally along the shores of the Hauraki Gulf and the left bank of the Maungamaungaroa Creek to the limit of tidal influence; thence up the middle of the Maungamaungaroa Stream to the northern side of Caldwells Road; thence south-easterly along that roadside to and northerly along the eastern boundary of Allotment 274, Pakuranga Parish, in Block VIII, Otahuhu Survey District, easterly along the southern boundary of part Allotment 117, as shown on D.P. 22300, to the easternmost corner of Allotment 118, as shown on D.P. 22300; thence westerly along the northern side of Saleyards Road to a point in line with the south-western boundary of Lot 7, D.P. 4431; thence south-easterly along a right line crossing the said road to and along the said boundary and the south-western boundary of Lot 8, D.P. 4431, to the northernmost corner of Allotment 178; thence south-westerly, southerly, and easterly along the north-western, western, and southern boundaries of the said allotment, southerly along the western boundary of Allotment 177, and westerly, southerly, and easterly along the northern, western, and southern boundaries of Allotment 138, all the said allotments being of Pakuranga Parish, to the north-western corner of Allotment 153, Manurewa Parish, in Block XII, Otahuhu Survey District; thence southerly along the western boundaries of the said allotment and Allotment 96, westerly and southerly along the northern and western boundaries of Allotment 95, the said allotments being of Manurewa Parish, to the north-eastern boundary of part Clendons Grant as shown on D.P. 515; thence south-easterly and south-westerly along the north-eastern and south-eastern boundaries of the said part of Clendons Grant as shown on D.P. 515 to a point on the northwestern side of Ranfurly Road in line with the north-western side of the Manurewa-Brookby road; thence south-westerly along a right line crossing Ranfurly Road to and along the north-western side of the Manurewa-Brookby road to a point in line with the south-western side of the Alfriston-Ardmore road; thence south-easterly along a right line crossing the Manurewa-Brookby road to and along the said south-western side and the south-western side of Mullins Road, to the northern side of the Papakura-Clevedon road and along a right line crossing the said road to and along the south-western side of Petersons Road to the north-western boundary of Allotment 235, Hunua Parish, in Block XI, Wairoa Survey District; thence south-westerly along the north-western boundaries of Allotments 235 and 146 (Defence Purposes, Gazette 1945, page 1556) to and along the north-western end of a closed road, along the north-western side of a public road forming the north-western boundaries of Allotments 145 and 144, all the said allotments being of Opaheke Parish, along the north-western boundary of Allotment 242, as shown on D.P. 26233, the abuttal of a public road and the north-western boundary of Allotment 116, Suburban Section 1, Opaheke Parish, and that last-named boundary produced to the western side of Dominion Road; thence northerly and westerly generally along the generally eastern and northern boundaries of the Papakura Borough to the shores of the Manukau Harbour; thence along the line of mean high water spring tides of those shores to a point in line with the northern side of Portage Road; thence easterly along a right line to the point of commencement, including Wiroa, Puketutu, Oruaruakihi, and other adjacent islands in the Manukau Harbour but excluding the Boroughs of Otahuhu, Howick, Papatoetoe, and Manurewa and the County Towns of Bucklands and Eastern Beaches, Mangere Bridge, Mangere East, and Pakuranga, and excluding also any part of the said portion of the Manukau County that may hereafter be constituted as a county town by the Manukau County Council under the provisions of section 416 of the Counties Act 1956.
