An Act to apply the Urban Farm Land Rating Act 1932 tothe Central Riding of the County of Rotorua
WHEREAS pursuant to section 43 of the Rating Act 1925 all rates made and levied by the Rotorua County Council in the County of Rotorua from and after the thirty-first day of March, nineteen hundred and sixty-one, have been made and levied on the unimproved value under the said Act: And whereas in the opinion of the Rotorua County Council the rates made and levied in the manner aforesaid have become excessive or unduly burdensome in the Central Riding of the County of Rotorua because of the rateable value thereof within the meaning of the Rating Act 1925: And whereas it is expedient and therefore desirable that the said Council be empowered to reduce the rateable value of the said lands for the purpose of making and levying rates within the said Central Riding of the County of Rotorua:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by authority of the same, as follows:
1 Short Title and commencement
(1)
This Act may be cited as the Rotorua County Urban Farm Land Rating Act 1965.
(2)
This Act shall be deemed to have come into force on the first day of April, nineteen hundred and sixty-five.
2 Urban Farm Land Rating Act 1932 to apply to Central Riding of the County of Rotorua
(1)
The Urban Farm Land Rating Act 1932 shall, as far as it is applicable and with the necessary modifications, apply with respect to the urban farm land situated within the Central Riding of the County of Rotorua described in the Schedule to this Act as if—
(a)
References in that Act to a borough were references to the Central Riding of the County of Rotorua described in the Schedule to this Act;
(b)
References in that Act to a borough council were references to the Rotorua County Council; and
(c)
References in that Act to the Town Clerk were references to the County Clerk of the County of Rotorua.
(2)
Notwithstanding the provisions of sections 3 and 17 of the Urban Farm Land Rating Act 1932, the Rotorua County Council shall forthwith cause a farm land list to be made out for the Central Riding of the County of Rotorua described in the Schedule of this Act in the manner prescribed by section 4 of the Urban Farm Land Rating Act 1932; and any farm land roll made in pursuance of such farm land list shall be deemed to have come into force on the first day of April, nineteen hundred and sixty-five.
3 Costs of promoting Act
The costs of promoting this Act, and of all matters preparatory and incidental thereto, shall be paid out of the Rotorua County Fund.
4 Duration of Act
This Act shall continue in force until the thirty-first day of March, nineteen hundred and sixty-six, and shall then expire.
Schedule Central Riding
Section 2
All that area in the South Auckland Land District, Rotorua County, bounded by a line commencing at the south-western corner of Whaka-poungakau 16 No. 2b 2f on the shores of Lake Rotorua in Block XIV, Rotoiti Survey District, and proceeding south-easterly along the boundary of the Rotoiti Riding as described in N.Z. Gazette, 1962, page 1019, to the northernmost corner of part Section 6, Block II, Tarawera Survey District; thence westerly along the northern boundaries of the said part Section 6, and Lot 1, D.P. S. 3313, to and south-westerly along the north-western boundaries of the said Lot 1 and Lot 2, D.P. S. 3313, and that last-named boundary produced to the middle of the Rotorua-Lake Tarawera Road; thence north-westerly along the middle of the said road to a point in line with the north-western boundary of Rotomahana Parekarangi 4a; thence along a right line between that last-mentioned point and the northernmost corner of part Rotomahana Parekarangi 6s 2b (State forest, N.Z. Gazette, 1927, page 2897) to the intersection of the middle line of State Highway No. 5; thence northerly along the eastern boundaries of Ngakuru and Mamaku Ridings as described in N.Z. Gazette, 1962, page 1020, to and generally northerly along the generally eastern boundary of Rotorua City as described in N.Z. Gazette, 1962, page 198, and north-easterly along the boundary of the Rotoiti Riding aforesaid to the point of commencement.
