An Act to amend the City of Dunedin Lands Vesting Act 1906 to enable the Dunedin City Council to regulate the use of certain land vested in the Corporation of the Mayor, Councillors, and Citizens of the City of Dunedin for the purposes of public recreation in like manner as a recreation reserve within the meaning of the Reserves and Domains Act 1953

WHEREAS the land described in the First Schedule to the City of Dunedin Lands Vesting Act 1906 was by the said Act vested in the Corporation of the Mayor, Councillors, and Citizens of the City of Dunedin in trust for purposes of public recreation: And whereas it is desirable that the said Council shall have the same powers with respect to the said land as it has in respect of other lands vested in it for like purposes, which lands are subject to the provisions of the Reserves and Domains Act 1953:

Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the City of Dunedin Lands Vesting Amendment Act 1965, and shall be read together with and deemed part of the City of Dunedin Lands Vesting Act 1906 (hereinafter called the principal Act).

2 Recreation reserve

The principal Act is hereby amended by repealing subsections (2), (3), and (4) of section 2, and substituting the following subsection:

“(2)

The said land shall be deemed to be a recreation reserve within the meaning of the Reserves and Domains Act 1953.”

3 Consequential amendment

The principal Act is hereby further amended by repealing section 4, and substituting the following section:

“4.

“(1)

The Land described in the First Schedule hereto shall not be subject to the provisions of the Ocean Beach Public Domain Act 1892 or any amendment thereof.

“(2)

The land described in the Second Schedule hereto shall not be subject to the provisions of the Reserves and Domains Act 1953 or the Ocean Beach Public Domain Act 1892 or any amendment thereof.”
