An Act to empower the Hawke’s Bay Catchment Board to adopt a system of rating in certain classified districts on the capital value of all the rateable properties in such districts
WHEREAS the Hawke’s Bay Catchment Board has, under the provisions of the Soil Conservation and Rivers Control Act 1941, made and levied rates upon the system of the capital value of all the rateable properties in the classified districts described in section 2 of this Act, rating on the system of the capital value having been adopted because the Board considers flood control works protect improvements on land as well as unimproved lands: And whereas as a result of a change in the system of rating in force in that part of the Taupo County in the Hawke’s Bay Catchment District from rating on the system of the capital value to rating on the system of the unimproved value the Hawke’s Bay Catchment Board will be compelled by section 4 of the Rating Act 1925 to adopt the system of rating on the unimproved value throughout its district: And whereas the Hawke’s Bay Catchment Board considers that in the said classified districts the adoption of a system of rating on the unimproved value would be inequitable without a reclassification of the said areas: And whereas such a reclassification is a lengthy and expensive process involving the possibility of considerable delays in adoption: And whereas until such a reclassification was adopted rates on the unimproved value would have to be made and levied and would produce inequitable and anomalous results:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Hawke’s Bay Catchment Board Rating Act 1966.
2 Interpretation
In this Act, unless the context otherwise requires,—
“Board” means the Hawke’s Bay Catchment Board:
“Classified districts” means firstly the Heretaunga Plains Flood Control Scheme Special Rating District defined in the resolution of the Board contained in the minutes of the Board for the twenty-sixth day of July nineteen hundred and sixty-one and shown on the plan numbered 555 deposited in the office of the Hawke’s Bay Catchment Board at Napier and thereon bordered black; and secondly the Upper Tuki Tuki River Control Scheme Special Rating District defined in the resolution of the Board contained in the minutes of the Board for the eighteenth day of May nineteen hundred and fifty shown on the plan numbered 515/1 deposited in the office of the Hawke’s Bay Catchment Board at Napier and thereon bordered red.
3 Authority to rate on the capital value
Notwithstanding anything to the contrary in the Rating Act 1925 or in any other enactment, the Board is hereby authorised to make and levy, and shall be deemed to have been authorised since the first day of April nineteen hundred and sixty-six to make and levy, upon all the rateable properties in the classified districts all rates leviable in accordance with the provisions of the Soil Conservation and Rivers Control Act 1941 based upon a classification of lands within those districts upon the system of the capital value.
