This Act may be cited as the Nelson City Empowering Act 1967.

In this Act unless the context otherwise requires,—

The land described in section 6 of this Act is hereby vested in the Corporation for an estate in fee simple freed and discharged from all former trusts, reservations, and restrictions affecting the same.

The District Land Registrar for the Land District of Nelson is hereby empowered and directed on deposit with him of a plan of the land described in section 6 of this Act to issue a certificate of title in favour of the Corporation in respect of the said land.

Notwithstanding the provisions of section 175 of the Harbours Act 1950 or of any other Act but subject to the provisions of sections 176 to 182 of the Harbours Act 1950 the Corporation is hereby authorised to reclaim the said land from the waters of the Port and Harbour of Nelson.

The land to which the preceding sections of this Act relates is particularly described as follows:

All that area in the Nelson Land District containing 188 acres 2 roods and 20 perches, more or less, being part Nelson Harbour Board Endowment situated in Blocks V and IX, Wakapuaka Survey District; as the same is more particularly delineated on Plan L.T. 7151 and on a plan deposited in the Marine Department at Wellington under No. M.D. 12647.

Notwithstanding the provisions of section 175 of the Harbours Act 1950 or of any other Act but subject to the provisions of sections 176 to 182 of the Harbours Act 1950 the Corporation is hereby authorised to reclaim from the waters of the Port and Harbour of Nelson the land owned by it and more particularly described in the next succeeding section.

The land to which the preceding section of the Act relates is particularly described as follows:

All that area in the City of Nelson containing 184 acres 2 roods and 10 perches, more or less, being Lot 1, D.P. 6968 and part Section 1167, City of Nelson, part Sections H. 13 and H. 14, District of Wakatu, part Paru Paru Road, and part Trafalgar Road situated in Block IX, Wakapuaka Survey District, and Block XVI, Moutere Survey District; as the same is more particularly delineated on Plan S.O. 10676 and on a plan deposited in the Marine Department at Wellington under No. M.D. 12646.

This Act shall be deemed to be a special Act for the purposes of the Harbours Act 1950.

Notwithstanding anything herein contained no work pursuant to this Act shall be commenced or carried out by the Corporation or on its behalf without the consent of the Board in writing first had and obtained and then so far only as such consent may authorise, and subject to any conditions or requirements that the Board may think necessary stipulated therein or imposed thereby as to the site of dredging or otherwise to ensure that the tidal compartment of Nelson Haven shall not be adversely affected by such work.
