An Act to amend the Waimakariri River Improvement

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Waimakariri River Improvement Amendment Act 1986, and shall be read together with and deemed part of the Waimakariri River Improvement Act 1922 (hereinafter referred to as the principal Act).

2 Interpretation

In this Act, unless the context otherwise requires, “Board” means the North Canterbury Catchment Board.

3 Land freed from reservations and trusts

The land described in the Schedule to this Act is hereby vested in the Board for an estate in fee simple freed and discharged from all reservations and trusts affecting it immediately before the commencement of this Act.

4 Power to subdivide land, etc.

(1)

The Board is hereby empowered—

(a)

To subdivide, improve, and develop all or any part of the land described in the Schedule to this Act:

(b)

To dedicate or transfer any part of that land as road, street, access way, or service lane or as part of a road, street, access way, or service lane or for a reserve or public utility:

(c)

To grant or reserve easements over any part of that land:

(d)

To expend money—

(i)

In the exercise of any of the powers conferred on the Board by paragraphs (a) to (c) of this subsection:

(ii)

On the construction, maintenance, or improvement of streets, roads, access ways, or service lanes which are situated on or which provide access to any part of that land:

(iii)

On the provision of services to any part of that land:

(iv)

On payments in lieu of the provision of reserves in any case where the making of such payments is a condition of approval of any subdivision of that land:

(v)

For any other purposes incidental to the subdivision, improvement, and development of any part of that land:

(e)

For the purpose of providing funds to enable it to exercise any of the powers conferred on it by this section, to raise a special loan under the Local Authorities Loans Act 1956 as for a public work.

(2)

Nothing in this section shall limit or affect the application of—

(a)

The Local Government Act 1974:

(b)

The Town and Country Planning Act 1977:

(c)

The Public Works Act 1981.

5 Power to sell land

(1)

Notwithstanding anything to the contrary in the principal Act or any other Act, the Board may sell by private treaty all or any part of the land described in the Schedule to this Act on such terms and conditions as it thinks fit.

(2)

Section 3(1) of the Waimakariri River Improvement Amendment Act 1930 shall not apply to the land described in the Schedule to this Act.

6 Powers of District Land Registrar

The District Land Registrar for the Canterbury Land Registration District is hereby authorised to deposit all such plans, issue all such certificates of title, accept all such documents for registration, make all such entries in the register, and do all such other things as may be necessary to give effect to the provisions of this Act.

7 Application of proceeds of sale

The whole of the net proceeds of the sale of any land under this Act shall be paid into the special account established under section 3(2) of the Waimakariri River Improvement Amendment Act 1930, and any of those proceeds may be expended by the Board in accordance with section 4(1)(d) of this Act and section 3(1)(d) of the Waimakariri River Improvement Amendment Act 1970.
