An Act to empower the Matamata-Piako District Council to sell land vested in it as a site for a public hall
BE IT ENACTED by the Parliament of New Zealand as follows:
1 Short Title
This Act may be cited as the Matamata-Piako District Council Empowering Act 1990.
2 Interpretation
In this Act, “Council”
means the Matamata-Piako District Council.
3 Cancellation of trusts, etc., in respect of hall site
(1)
The land described in the Schedule to this Act is hereby declared to be vested in the Council for an estate in fee simple freed and discharged from all trusts and reservations affecting it immediately before the commencement of this Act, but subject to all leases, easements, liens, encumbrances, and other restrictions then affecting it.
(2)
On the commencement of this section the classification of the land described in the Schedule to this Act as a local purpose reserve under the Reserves Act 1977 shall be deemed to have been revoked.
4 Power to sell hall site
Notwithstanding the provisions of the Local Government Act 1974 or of the Reserves Act 1977, the Council may sell the land described in the Schedule to this Act or any part or parts of it in such manner, at such price, and on such terms and subject to such conditions as it thinks fit.
5 Application of purchase money
Where any land or interest in land is sold under section 4 of this Act, the purchase money and any money received as interest on unpaid purchase money shall be applied by the Council towards the maintenance or development of the Waharoa War Memorial Hall (which is a hall owned by the Council).
Schedule Land Authorised to be Sold
Sections 3, 4
1.
All that piece of land situated at Waharoa in the County of Matamata containing 506m2, more or less, being all the land on Deposited Plan 11511, and being also all the land in certificate of title 277/38 (South Auckland Registry).
2.
All that piece of land situated at Waharoa in the County of Matamata containing 197m2, more or less, being Lot 27 on Deposited Plan 14095, and being also all the land in certificate of title 356/40 (South Auckland Registry).
