An Act to amend the Hamilton Parsonage Site Act, 1904.
Preamble.
WHEREAS by the Hamilton Parsonage Site Act, 1904, the trustees of Allotment number fifty in the Town of Hamilton West were given power to sell or lease the said Allotment and to purchase other freehold lands and hereditaments or to exchange the said Allotment for other freehold lands and hereditaments and the terms on which the revenues arising from such lands were to be applied were settled: And whereas by section one hundred and forty-two of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1925, paragraph (b) of section six of the Hamilton Parsonage Site Act, 1904, was amended: And whereas the General Synod of the Province of New Zealand, the Synod of the Diocese of Waikato, the Greater Chapter of the Cathedral of Saint Peter at Hamilton, the Vestry of the Parochial District of Saint George’s at Frankton Junction, and the committee of the conventional district of Saint Aidan’s at Claudelands, Hamilton, being all the church bodies interested in the trust affected by the legislation hereinbefore mentioned are desirous of having the said legislation amended in the manner hereinafter set out:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Hamilton Parsonage Site Amendment Act, 1937, and shall be read together with and deemed part of the Hamilton Parsonage Site Act, 1904 (hereinafter referred to as the principal Act).
2 Section 6 of principal Act amended.
Paragraph (b) of section six of the principal Act (as set out in section one hundred and forty-two of the Reserves and other Lands Disposal and Public Bodies Empowering Act, 1925) is hereby amended by repealing subparagraph (ii) thereof, and substituting the following subparagraph:—
“(ii)
After the expiration of the said period of twenty-one years any moneys remaining out of such rents shall be applied by the trustees—Firstly, in payment of the annual sum of six hundred pounds for the purpose or purposes set out firstly in subparagraph (i) of this paragraph; secondly, in payment of two-thirds of the then remainder of such moneys to the Cathedral Chapter of Saint Peters at Hamilton for the maintenance or staffing of the Cathedral Church of Saint Peter at Hamilton, and one-third of such then remainder to the Vestry of Saint George’s Church at Frankton Junction:
“Provided, however, that any payments authorized by this paragraph (b) to be made towards the stipend of the Bishop of Waikato or towards the provision or maintenance of a See House for the said Bishop shall be made only so long as the Diocese of Waikato is administered from and the said Bishop resides at Hamilton.”
3 Private Act.
This Act is hereby declared to be a private Act.
