An Act to enable the Governor to set apart a portion of a Reserve in the City of Auckland as a site for a Music Hall and other buildings and to issue a Crown Grant of the same.
Preamble.
WHEREAS certain lands in the city of Auckland lying to the North of the Albert Barracks are intended to be used for the erection of Public Buildings And whereas an arrangement has been entered into for the issue of a Grant of part of such land to certain individuals or a corporation on condition of the grantees erecting and maintaining thereon a Public Hall or Halls and such other buildings as the grantees should think proper subject to the conditions hereinafter contained And it is desirable to give validity to such arrangement and to empower the Governor to issue a Crown Grant for such land:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows:
I Short Title.
The Short Title of this Act shall be “The Albert Hall Act 1864.”
II Governor to sanction arrangements for erection of a Music Hall.
It shall be lawful for the Governor by writing under his hand to sanction any arrangements already entered into or to be entered into with any person or body corporate for the erection of a Music Hall on the land described in the Schedule hereunto annexed.
III And to issue Crown Grants of site of same on certain conditions.
It shall be lawful for the Governor to issue to such person or body corporate a Crown Grant for the land described in the Schedule hereunto annexed upon the following conditions:—
a.
That a Hall available for musical performances and other purposes calculated for the advancement of knowledge and the improvement of the taste of the public shall always be maintained on the land to be granted.
b.
That no building shall be erected upon the land aforesaid until the approval of the Government shall have been obtained both as to style and character of its architecture and the purposes to which it is intended to be devoted.
c.
That any such approved purpose shall not be changed at any time without the approval and sanction of Government.
d.
That in the event of the building being destroyed by fire or otherwise it shall be replaced by the grantees to the satisfaction of the Government.
e.
That upon a breach of any of the foregoing conditions it shall be lawful for the Government at their discretion to declare the Grant aforesaid to be forfeited to the Crown and to enter upon and resume possession of the land hereby authorized to be granted.
IV Conditions
Provided always that the space between the Western boundary of the land hereby authorized to be granted and the Eastern side of the proposed road mentioned in the Schedule hereto appended shall always be kept open and free from buildings of any kind except such as may be required to give better access from the road to the buildings to be authorized under this Act.
V Effect of Grant.
Such grant shall confer upon the grantees their heirs assignees and successors as the case may be an estate of inheritance in possession free from all encumbrances and subject only to the observance of the aforesaid conditions.
VI Duration of Act.
This Act shall cease to have force and shall expire at the expiration of one year from the passing hereof unless a contract for the building of the Hall above mentioned shall have been accepted and the building bonâ fide commenced within such period of one year.
Schedule
All that piece or parcel of land situate West of the present road from Princes Street to the Albert Barrack gate containing one rood and eleven perches Bounded on the North 85 feet by a line parallel to Waterloo Crescent and 385 feet from the North side thereof commencing at the point where the said line intersects the Eastern side of the proposed new road from Princes Street to Victoria Street on the East 180 feet by a straight line perpendicular to the Northern boundary drawn from its Eastern extremity on the South by a straight line 85 feet drawn from the Southern end of the Eastern boundary and at right angles thereto and on the West 180 feet by a straight line connecting the Western extremities of the North and South boundaries and parallel to the Eastern boundary which said piece of land is delineated and coloured blue on a certain plan of Public Building Sites dated 12th December 1864 prepared for the Commissioners appointed by His Excellency the Governor under date of 29th February 1864 for the erection of Public Buildings at Auckland.
