An Act to amend “The Westland Representation Act 1867.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled and by the authority of the same as follows—
1 Short Title.
The Short Title of this Act shall be “The Westland Representation Amendment Act 1868.”
2 Alteration of District of the Westland Boroughs.
For the purpose of any future election of Members for the House of Representatives instead of the Electoral District of the Westland Boroughs as defined in “The Westland Representation Act 1867”
and the Schedule thereto and for which district it is by the said Act provided that one Member shall be returned to the House of Representatives there shall be an Electoral District to be called “The Westland Boroughs”
the boundaries whereof are defined and set forth in the Schedule hereto for which one Member shall be returned to the said House of Representatives.
3 Parts of the District of Westland South as formerly constituted to cease to belong to that district.
All portions of the Colony hitherto comprised within the Electoral District of Westland South and now included within the Electoral District of the Westland Boroughs as defined in the Schedule to this Act shall for the purposes of all future elections of Members of the House of Representatives cease to form part of the Electoral District of Westland South and the district of Westland South as hitherto constituted (with the exception of those parts so now included in the district of the Westland Boroughs) shall remain and be an Electoral District under the name of “Westland South”
for which one Member shall be returned to the said House of Representatives.
4 Maps of districts.
The Electoral Districts of the Westland Boroughs and of Westland South as constituted or altered by this Act are delineated on maps or plans authenticated for the purposes of this Act by the signatures of the Speakers of the Legislative Council and of the House of Representatives respectively and are deposited in the Office of the Colonial Secretary And any city or town which shall by any Proclamation made under the authority of “The Westland Representation Act 1867”
or this Act be declared to form part of the Electoral District of the Westland Boroughs shall be delineated on a map authenticated by the signature of the Governor and shall be deposited within seven days after the day of the first publication of the Proclamation relating to such city or town in the Office of the Colonial Secretary.
5 Registration Officers to form new rolls.
The Registration Officers appointed for the Districts of the Westland Boroughs and Westland South respectively under “The Westland Representation Act 1867”
shall be the Registration Officers for the districts of the same names respectively by this Act constituted defined or altered and such Registration Officers shall immediately after the passing of this Act form new electoral rolls for such last-mentioned districts respectively.
6 Mode of forming new rolls.
For the purpose of framing such new electoral rolls the name of every elector on the roll for the time being in force under the provisions of “The Registration of Electors Act 1866”
for either of the Electoral Districts of the Westland Boroughs or Westland South as constituted before the passing of this Act whose qualification is in respect of lands or tenements situated within either of the electoral districts constituted defined or altered by this Act shall be placed on the new electoral roll of that one of the electoral districts constituted defined or altered by this Act in which the lands or tenements in respect whereof he is so registered are situate or if such lands or tenements are situate in both of the districts constituted defined or altered by this Act then the name of such elector shall be placed on both the new electoral rolls of the districts constituted defined or altered by this Act within which such lands or tenements are situate Provided that if any elector on the former rolls be registered in respect of lands or tenements situate in both the districts by this Act constituted defined or altered the Registration Officer for either such district may in forming the new roll of such district omit the name of such elector from such roll if it shall appear to the Registration Officer that such elector has not within the district for which such roll is formed a sufficient electoral qualification.
7 Publication and duration of rolls.
Upon such new electoral rolls being so framed as aforesaid the same shall forthwith be forwarded to the Colonial Secretary and shall be published in such convenient manner as the Governor shall direct and from the day of such publication the electoral roll formed for each district shall be the electoral roll to be used for such district for all purposes until a revised electoral roll for the same shall be in force under the provisions of the law for the time being in force relating to the registration of electors.
8 Present Members to represent districts as altered.
The person who has been returned to serve as and who at the time of the passing of this Act is Member of the said House of Representatives for the Electoral District of the Westland Boroughs as constituted before the passing of this Act shall so long as he retains his seat be and be deemed to be for all purposes the Member of the said House for the Electoral District of the Westland Boroughs as constituted defined or altered by this Act And the person who has been returned to serve as and who at the time of the passing of this Act is Member of the said House for the Electoral District of Westland South as constituted before the passing of this Act shall so long as he retains his seat be and be deemed to be for all purposes the Member of the said House for the Electoral District of Westland South as constituted defined or altered by this Act.
9 Sections 4 11 12 and 13 of “The Westland Representation Act 1867”
to apply to districts under this Act.
In the construction of the provisions of the sections numbered four eleven twelve and thirteen respectively of “The Westland Representation Act 1867”
the expressions “the Westland Boroughs”
and “Westland South”
shall respectively from the time of the passing of this Act be held and taken to mean and apply to the Electoral Districts of the Westland Boroughs and Westland South as the same are respectively constituted defined or altered by this Act.
Schedule The Westland Boroughs
The Electoral District of the Westland Boroughs comprises the Towns of Hokitika and Greymouth and shall also comprise such other towns or cities as shall from time to time be proclaimed by the Governor under the fourth section of “The Westland Representation Act 1867”
as included in and forming part of the Electoral District of the Westland Boroughs And for the purposes of this definition the Town of Hokitika shall comprise all that area containing six hundred and forty (640) acres more or less situate on the Hokitika River commencing at a point on the high bank of the old bed of the aforesaid river the said point being forty (40) chains forty (40) links west of the Trigonometrical Station thirty-one (31) thence following a line bearing North twenty degrees fourteen minutes East (magnetic) a distance of sixty-two (62) chains sixty-five (65) links thence westerly at a right angle a distance of eighty-five (85) chains forty (40) links to the sea beach following the said beach southerly to the mouth of the Hokitika River and from thence returning along the northern bank thereof and the high bank of the old river bed above mentioned to the commencing point and also all that parcel of land containing six hundred and forty (640) acres more or less situate on the Hokitika River bounded on the Northward by reserve two hundred and seventy-one (271) in red on the Westward by the sea on the East by section number eight thousand two hundred and thirty-eight (8238) and a line in continuation of the western boundary thereof and on the Southward by a line at right angles to the last described boundary and about one hundred and thirty (130) chains distant on the average from the reserve above mentioned And the Town of Greymouth shall comprise all that area of land in the County of Westland bounded on the West by a line of one hundred and sixty (160) chains and eighty (80) links extending from the South Spit at the mouth of the River Grey along the beach thence along the South Town Belt one hundred and fifteen (115) chains and fifty (50) links thence along the East Town Belt one hundred and twenty (120) chains and ninety (90) links thence along the Native Reserve numbered thirty-one (31) for a distance of forty-one (41) chains thirty (30) links to the River Grey and thence along the River Grey to the point of commencement.
