An Act to validate the Proceedings of certain District Courts.
Preamble.
WHEREAS under the powers conferred by “The District Courts Act, 1858”
(herein called “the said Act”
), certain districts named in the Schedule hereto hare been constituted under the said Act, or the boundaries of such districts have been altered: And whereas such districts have been described by the boundaries of the counties named in the said Schedule, and Courts in such districts have exercised their jurisdiction in or in respect of boroughs which are not within the boundaries of counties, and doubts have arisen as to the validity of such exercise of jurisdiction, and it is expedient to declare that such boroughs shall be deemed to have been included in the districts so constituted:
Be it therefore declared and enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The District Courts Proceedings Validation Act, 1879.”
2 Boroughs where District Courts have held sittings to be deemed to have been included in districts mentioned in the Schedule to this Act.
Every borough in or in respect of which the District Court constituted for any district mentioned in the Schedule hereto shall have held any sitting, or exercised any jurisdiction, shall be, and at all times since the constitution or other definition of such district be deemed to have been, included within the district in which such District Court was empowered to hold sittings and exercise jurisdiction.
3 Powers of Judges of District Courts to grant probates of wills and letters of administration within their own districts.
Whereas doubts have arisen as to the powers of Judges of District Courts to grant probates of wills and letters of administration within their own districts: Be it enacted that the Judge of every District Court has had and shall have the same power as the Supreme Court to grant probates of wills and letters of administration within his own district, unless the office of the Registrar of any district of the Supreme Court has been or shall be at the time of the granting of the same situate within the district of such District Court.
