An Act to enable the Honourable Sir George Stoddart Whitmore, K.C.M.G., to hold the Office of Commander of Her Majesty’s Colonial Forces without vacating his Seat in the Legislative Council.
Preamble.
WHEREAS the Honourable Sir George Stoddart Whitmore, K.C.M.G., a Member of the Legislative Council of New Zealand, has been appointed the Commander of Her Majesty’s Colonial Forces in New Zealand: And whereas it is proposed to attach pay to the said office, and the acceptance thereof by the said George Stoddart Whitmore would vacate his seat as a member of the said Council: And whereas, having regard to the circumstances of his appointment as such Commander, it is reasonable and expedient that his seat in the said Council should not be vacated, but that he should not sit or vote therein during the time of his holding the said office of Commander:
Be it therefore enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Whitmore Enabling Act, 1885.”
2 Sir George Stoddart Whitmore’s seat as a member of the Council not vacated by his acceptance of the office of Commander.
The acceptance by the said George Stoddart Whitmore of the said office of Commander, and his holding the same and receiving pay therefor, shall not vacate his seat as a member of the said Council: Provided that, during the time that he holds the said office of Commander, be does not sit or vote in the said Council as a member thereof, and by his failing to give his attendance his seat shall not thereby become vacant.
