Contents
An Act to vest certain Reserves in the Corporations of certain Boroughs, also to authorise the Sale of a Portion of the Recreation Reserve at Roxburgh, and for other Purposes.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Public Reserves Vesting and Sale Act, 1892.”
2 Land in First Schedule to vest in Corporation of Tauranga as endowments.
The parcels of land described in the First Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the Borough of Tauranga as endowments for the said borough.
3 Land in Second Schedule to vest in Corporation of Palmerston North.
The parcels of land described in the Second Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the Borough of Palmerston North as endowments for the said borough.
4 Land in Third Schedule to vest in Corporation of Hokitika.
The parcels of land described in the Third Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the Borough of Hokitika as endowments for the said borough.
5 Land in Fourth Schedule to vest in Corporation of Sydenham.
The parcel of land described in the Fourth Schedule to this Act shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Sydenham as an endowment for the said borough.
6 Land in Fifth Schedule to vest in Corporation of Palmerston.
The parcel of land first described in the Fifth Schedule to this Act shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Palmerston, and shall be held by the said Corporation in trust for the purposes of the Palmerston Free Library.
The Corporation may lease the said land, or any part thereof, by public auction, for any term not exceeding twenty-one years, at such rent and on such terms and conditions as to them may seem fit.
The Corporation shall apply the rents, profits, and annual income arising from the said land in and towards the objects and purposes of a free library for the Borough of Palmerston.
The parcel of land secondly described in the said Schedule shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Palmerston as a site for the Borough Council Offices.
7 Land in Sixth Schedule to vest in Corporation of Dunedin.
The parcels of land described in the Sixth Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the City of Dunedin as endowments for the said city.
8 Land in Seventh Schedule to vest in Corporation of Dunedin.
The parcels of land described in the Seventh Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the City of Dunedin, and shall be held in trust for the conservation of the water-supply of the said city and for the preservation of timber.
9 Land in Eighth Schedule to vest in Corporation of Caversham.
The parcel of land described in the Eighth Schedule to this Act shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Caversham as a site for a public library.
10 Land in Ninth Schedule to vest in Corporation of Kaitangata.
The sections of land described in the Ninth Schedule to this Act shall be and the same are hereby vested in and transferred to the Corporation of the Borough of Kaitangata as endowments for the said borough.
11 Borough Council of Roxburgh authorised to sell or lease land in Tenth Schedule.
Out of the lands described in the Schedule to “The Roxburgh Reserve Management Ordinance, 1875”
(No. 515), of the Superintendent and Provincial Council of Otago, which by the said ordinance were vested in and transferred to the Corporation of the Town of Roxburgh, to be held by the said Corporation and its successors in trust for purposes of recreation, the Borough Council of Roxburgh may subdivide and sell or lease the area described in the Tenth Schedule to this Act; and, upon payment of the purchase-money or rent of the land when sold or leased, the said Council may, in the name and on behalf of the Corporation of the borough, transfer the said land to the several purchasers or lessees thereof, and shall expend the moneys received from such sale or lease in the improvement of the remaining part of the recreation-ground.
12 Recreation-reserve in Eleventh Schedule to vest in Corporation of Queenstown.
The parcel of land described in the Eleventh Schedule to this Act shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Queenstown as an endowment for the said borough.
13 Land in Twelfth Schedule to vest in Corporation of Invercargill.
The parcel of land described in the Twelfth Schedule to this Act, together with the buildings erected thereon, shall be and the same is hereby vested in and transferred to the Corporation of the Borough of Invercargill as a site for a town-hall and municipal offices.
14 Land in Thirteenth Schedule to vest in Wallace and Fiord Hospital Contributors.
The parcel of land described in the Thirteenth Schedule to this Act shall cease to be a recreation-ground, and is hereby vested in and transferred to the body corporate known as the Wallace and Fiord Hospital Contributors, as an addition to the grounds of the hospital.
15 Exchange of endowment - land of Naseby Athenaeum.
On the surrender to Her Majesty by the Committee of the Naseby Athenaeum of the parcel of land granted to them for the Athenaeum under the authority of “The Special Powers and Contracts Act, 1882,”
being Section two, Block five, Swinburn Survey District, containing two hundred acres, more or less, but which is found unsuitable for the purpose, the Governor may by warrant authorise the issue of a certificate of title to the said Athenaeum of Section eleven, Block eleven, Naseby Survey District, containing five hundred and four acres two roods and four perches, as an endowment for such Athenaeum.
16 Saving of rights of lessees.
All lands transferred or vested in any manner by this Act shall be so transferred or vested respectively subject to all existing leases thereof, and to the rights of any lessees of the said lands respectively.
17 Crown grant for certain section, New Plymouth, to issue to Native named Karira.
In supplement of an authority given by “The Special Powers and Contracts Act, 1885,”
wherein an omission of a section was made, the Governor may issue a Crown grant to Karira for Section one thousand eight hundred and fifty-nine, in the Borough of New Plymouth. The legal estate to vest from the twenty-third day of October, one thousand eight hundred and fifty-five.
18 Crown grant may issue for homestead section to John Shore.
The Governor may issue a Crown grant for Section thirteen, Block one, Awakino Survey District, in the Land District of Auckland, containing thirty-six acres, more or less, to John Shore, be having occupied and improved the said land in accordance with the conditions of the homestead system, notwithstanding any informality made by him in his original application for the said land.

FIRST SCHEDULE TAURANGA
ALL that parcel of land in the Auckland Land District, containing by admeasurement 2 roods, more or less, being Lot 163, Section 1, Town of Tauranga. Bounded towards the north by Spring Street; towards the east by Durham Street; towards the south by Lot 164; and towards the west by Lot 149.
All that parcel of land in the Auckland Land District, containing by admeasurement 37 perches, more or less, being Lot 247, Section 1, Town of Tauranga. Bounded towards the north by Park Street; towards the east by the sea; towards the south by Monmouth Street; and towards the west by Cliff Road.
All that parcel of land in the Auckland Land District, containing by admeasurement 1 rood 37 perches, more or less, being Lots 234 and 235, Section 1, Town of Tauranga. Bounded towards the north by Spring Street; towards the east by the sea; towards the south by Lot 236; and towards the west by Devonport Street.
All that parcel of land in the Auckland Land District, containing by admeasurement 2 roods 32 perches, more or less, being Lot 288, Section 1, Town of Tau ranga. Bounded towards the north by Harrington Street; towards the east by Durham Street; towards the south by Hamilton Street; and towards the northwest by Cameron Street.
All that parcel of land in the Auckland Land District, containing by admeasurement 2 roods, more or less, being Lots 83 and 84, Section 2, Town of Tauranga. Bounded on the north by Lot 82; towards the east by Lots 81 and 86; towards the south by Lot 85; and towards the west by Cameron Road.
All that parcel of land in the Auckland Land District, containing by admeasurement 2 acres 2 roods, more or less, being Lot 298, Section 1, Town of Tauranga. Bounded towards the north-west by Cemetery Reserve; towards the east by the sea; towards the south-east by Brown Street; and towards the West by Cliff Road.
SECOND SCHEDULE PALMERSTON NORTH
ALL that parcel of land in the Wellington Land District, containing by admeasurement 2 roods 7 perches, more or less, being parts of Sections 639 and 640, Town of Palmerston North. Bounded towards the north-west by Main Street; towards the north-east by a Drain Reserve of 25 links in width; towards the south-east by Church Street; towards the south-west by Section 642; and again towards the north-west and southwest by the Drill-shed Reserve.
All that parcel of land in the Wellington Land District, containing by admeasurement 30 perches, more or less, being part of Section 662, Town of Palmerston North. Bounded towards the north-west by Main Street; towards the north-east by Section 660; towards the south-east by a right-of-way 15ft. in width; towards the south-west by the public Square.
All that parcel of land in the Town of Palmerston North, containing by admeasurement 3 roods 1 perch, more or less, being part of the Railway Reserve through the public Square. Bounded towards the north-west by part of the public Square, 850 links; towards the north-east by the street on the north-eastern side of the public Square, 89 links; towards the south-east by the other part of the Railway Reserve, 850 links; and towards the south-west by the street on the south-western side of the public Square, 89 links: as the said parcel of land is shown coloured purple on plan No. 5039, deposited in the office of the New Zealand Railway Commissioners.
All that parcel of land in the Town of Palmerston North, containing by admeasurement 1 acre 1 rood 31 perches, more or less, being part of the Railway Reserve through the public Square. Bounded towards the north-east by the street on the north-eastern side of the public Square, 170 links; towards the south-east by part of the public Square, 850 links; towards the south-west by the street on the southwestern side of the public Square, 170 links; and towards the north-west by the other part of the Railway Reserve, 850 links: as the said parcel of land is shown coloured purple on Plan No. 5039, deposited in the office of the New Zealand Railway Commissioners.
THIRD SCHEDULE Hokitika
All that parcel of land in the Town of Hokitika, containing by admeasurement 11 acres, more or less, being Section 492, known as Whitcombe Square. Bounded towards the north-east by Tudor Street; towards the south-east by Hall Street; towards the south-west by Park Street; and towards the north-west by Fitzherbert Street.
All that parcel of land in the Town of Hokitika, containing by admeasurement 11 acres, more or less, being Section 589, known as Howitt Square. Bounded towards the north-east by Tudor Street; towards the south-east by Hoffman Street; towards the south-west by Park Street; and towards the north-west by Davie Street;
All that parcel of land in the Town of Hokitika, containing by admeasurement 10 acres, more or less, being Section 445. Bounded towards the north-east by Stafford Street; towards the south-east by Hoffman Street; towards the south-west by Weld Street; and towards the north-west by Davie Street.
FOURTH SCHEDULE SYDENHAM
ALL that parcel of land in the Borough of Sydenham, in the Canterbury Land District, containing by admeasurement 1 acre 1 rood 11 perches, more or less, being part of Rural Section 72 on the map of the Chief Surveyor of the said land district, setting out and describing the rural lauds in the Christchurch Survey District. Bounded towards the north-west by Poulson Street, 349 links; towards the east by a right-of-way, 390 links; towards the north by the said right-of-way, 30 links; again towards the east by other part of Section 72 aforesaid, 162 links; towards the south-east by Jackson’s Creek, 805 links; and towards the west by other part of Section 72 aforesaid, 416 links: be all the aforesaid linkages more or less.
FIFTH SCHEDULE PALMERSTON
ALL that parcel of land in the Otago Land District, containing by admeasurement 859 acres 2 roods, more or less, situate in the Dunback District, and being Section 8 of Block VI. of said district. Bounded towards the north-west by a road-line, 11930 links; towards the north-east by Section 4 of Block HI., Dunback District, 7069 links; towards the south-east by Sections 1 and 6 of Block XI., Dunback District, 12686 links; towards the south-west by a road-line, 8543 links: be all the aforesaid linkages more or less.
All that parcel of land in the Town of Palmerston, in the Otago Land District, containing by admeasurement 1 rood, more or less, being Section 15, Block XVII. Bounded towards the north by Section 5; towards the east by Section 14; towards the south by Copinsha Street; and towards the west by Section 16.
SIXTH SCHEDULE DUNEDIN CITY
ALL that parcel of land in the City of Dunedin, containing by admeasurement 2 roods 25 perches, more or less, bounded towards the north-east by Sections 7, 8, 9, and 10, Block XXXVI.; towards the south-east by Forth Street; towards the south and again towards the south-east by the other portion of Section 10 aforesaid; again towards the south by the Water of Leith; and towards the north-west by a right line, being the production in a southerly direction of the north-western boundary of Section 7 aforesaid.
All that parcel of land in the City of Dunedin, containing by admeasurement 2 roods, more or less, being Sections 42 and 43, Block XXVII. Bounded towards the north-east by a public road along the southern side of the Water of Leith; towards the south-east by Clyde Street; towards the south-west by Sections 44 and 41; and towards the north-west by Leith Street.
All that parcel of land in the City of Dunedin, containing by admeasurement 1 acre 1 rood 26 perches, more or less, bounded towards the north-west by Forth Place; towards the south-east by Queen Street; and towards the south-west by Regent Road.
SEVENTH SCHEDULE DUNEDIN CITY
ALL that area in the Otago Land District, containing by admeasurement 7,300 acres, more or loss, situated partly in Silver Peak Survey District, partly in North Harbour and Blueskin Survey District, and partly in Dunedin and East Taieri Survey District. Bounded towards the north by a line due east from Silver Peak, 8800 links; towards the east by a line due south to Trig. Station U, 2900 links; again towards the north by a line due oast, 3000 links; again towards the cast by a line due south, 4800 links; again towards the north by a line due cast, 9900 links; again towards the east by a line due south, 7200 links; thence towards the south-east by a line through Trig. Station Q to north boundary of Dunedin and East Taieri Survey District, 24900 links; towards the south by a line due west, 23300 links; towards the west by a line due north, 13200 links; thence again towards the north by a line through Trig. Station B to Trig. Station D, 14600 links; and towards the north-west by a line to Silver Peak, the starting-point, 19100 links: be all the aforesaid linkages more or less.
All that area in the Otago Land District, containing by admeasurement 2,019 acres 2 roods 34 perches, more or less, situated in the Silver Peak and North Harbour and Blueskin Survey Districts. Bounded towards the north-west and west by the Dunedin Waterworks Reserve; again towards the north-west by a road-line south-east of Section No. 32 of Block III., North Harbour and Blueskin Survey District; towards the south-east and north-east by Section No. 30 of said block; again towards the south-east by Sections Nos. 24, 15, 16, and 18 of said block; and towards the south by the Dunedin and East Taieri Survey District.
All that area in the Otago Land District, containing by admeasurement 2,490 acres 3 roods 19 perches, more or less, situated in the Waikouaiti Survey District, being Section No. 2, Block X., on the map of the said district. Bounded towards the north by a road-line; towards the east by Section No. 6, Block IX.; towards the south-east by reserve along the Waikouaiti River; towards the south by Section No. 10, Block XI.; and towards the west by the Silver Peak District.
All that area in the Otago Land District, containing by admeasurement 1,406 acres 3 roods 25 perches, more or less, situated in the Waikouaiti Survey District, being Section No. 10, Block XL, on the map of the said district. Bounded towards the north by Section No. 2, Block X.; towards the south-east by reserve along the Waikouaiti River; towards the south by Block III., North Harbour and Blueskin District, and reserve for Dunedin Water-supply, Silver Peak District; and towards the west by the Silver Peak District.
All that area situated in the Otago Land District, containing by admeasurement 699 acres 1 rood 17 perches, more or less, being Section No. 1 of Block X., Waikouaiti Survey District. Bounded towards the north by Section No. 1, Block VII.; towards the east by Section No. 6, Block IX., Waikouaiti Survey District; towards the south by a road-line; and towards the west by Section No. 1, Block V., and Section No. 1, Block VII., Silver Peak Survey District.
All that area in the Otago Land District, containing by admeasurement 39 acres 3 roods 21 perches, more or less, situated in the North Harbour and Blueskin District, and being Sections Nos. 64 and 65, Block VIII., of the said district. Bounded towards the north by Section No. 18 of Block III. of same district; towards the north-east and east by a road-line; towards the south-east by Section No. 63 of Block VIII. of said district; and towards the west by Sections Nos. 1 and 2 of Block V., Dunedin and East Taieri District.
All that area in the Otago Land District, containing by admeasurement 411 acres, more or less, situated in the Dunedin and East Taieri District, and being Sections respectively Nos. 1, 2, 60, and 77 of Block V. of said district. Bounded towards the north by Section No. 18 of Block III., North Harbour and Blueskin District; towards the south-east generally by Sections respectively Nos. 64 and 63 of Block VIII., North Harbour and Blueskin District, by Sections Nos. 80, 63, and 78, Block V., Dunedin and East Taieri District; towards the south-west by a road fronting Section No. 76; and towards the west generally by Section No. 9 of said Block V., Dunedin and East Taieri District, by Section No. 10 of same block, by Section No. 8 of said Block V., also by Section No. 3 of same block: and intersected by a road-line 100 links wide, also by another road-line, 50 links wide.
All that area in the Otago Land District, containing by admeasurement 194 acres and 3 perches, more or less, situated in the North Harbour and Blueskin District being Sections respectively Nos. 44, 66, 67, 68, 69, 70, 71, 72, 73, 74, and 75, Block VIII., North Harbour and Blueskin District. Bounded towards the north by Block III.; towards the east by Block XII.; towards the south-east by Section No 55 Block VIII.; towards the south-west by Sections Nos. 43 and 57; again towards the south-east by Section No. 57; and again towards the south-west by Section No. 63.
All that area situated in the Otago Land District, containing by admeasurement 903 acres 2 roods 26 perches, more or less, being Section No. 32, Block III. North Harbour and Blueskin Survey District. Bounded towards the north by Sections Nos. 10, 5, 7, and 6, Block XI., Waikouaiti Survey District; towards the south-east by a road-line and Sections Nos. 30 and 33, Block III., North Harbour and Blueskin Survey District; and towards the south and west by the Dunedin Waterworks Reserve.
EIGHTH SCHEDULE CAVERSHAM
ALL that parcel of land in the Otago Land District, containing by admeasurement 2 roods 30 perches, more or less, being part of Section 11, Block VI., Town District. Bounded towards the north by the Railway Reserve; towards the north-east by aright line parallel to and 81ft. distant from the north-eastern boundary of Section 12; towards the south-east by the main South Road; and towards the south-west by Section 12.
NINTH SCHEDULE KAITANGATA
SECTIONS 11, 12, 13, and 14, Block LXXI1L, containing 3 rood 32 porches; Sections 1, 2, 3, 4, 5, and 6, Block LXXIX., containing 5 acres 1 rood 20 perches; Sections 9 and 10, Block LXXX., containing 4 acres 1 rood 6 perches; Sections 1, 2, 3, 4, 5, 6, and 7, Block LXXXII., containing 1 acre 3 roods 20 porches; Sections 1, 2, 3, and 4, Block LXXXIII., containing 2 roods 39.3 perches; all in the Borough of Kaitangata.
TENTH SCHEDULE ROXBURGH
ALL that parcel of land in the Otago Land District, containing by admeasurement 48 acres, more or less, being part of Section 33, Block II., Teviot Survey District. Bounded towards the north by a road, Section 10, Block XXIV., Town of Roxburgh, and Till Street; towards the east generally by the main road; towards the south by Section 9, Block XIV., Benger District; and towards the west by Sections 11 and 15, Block X., Teviot District: excluding Section 33F.
ELEVENTH SCHEDULE QUEENSTOWN
ALL that parcel of land in the Otago Land District, situate in the Town of Queenstown, containing by estimation 1 rood 20 perches, more or less, and marked “Recreation Reserve”
on the map of the said town. Bounded towards the north-west by Sections 23, 22, 21, 20, 19, 18, 17, 16, 15, 14, 13, 12, 11, 10, 9, 8, 7, 6, 5, 4, 3, and 2, Block XV., and two rights-of-way, 780 links; towards the north-east by Sections 13, 12, 11, 10, 9, 8, 7, 6, 5, 2, and 1, Block XIV., 308 links; towards the south-east by Marine Parade, 50 links; towards the south-west by high-water mark of Lake Wakatipu, 260 links; towards the south-east by high-water mark of Lake Wakatipu 756 links, and also by Hay Street 27 links.
TWELFTH SCHEDULE INVERCARGILL
ALL that parcel of land containing by admeasurement 2 roods, more or less, situate in the Borough of Invercargill, being Sections 17 and 18, Block III., on the record map of the Town of Invercargill. Bounded on the north by Sections 5 and 6, 200 links; on the east by Section 16, 250 links; on the south by Tay Street, 200 links; and on the west by Section 19, 250 links: together with the buildings erected thereon.
THIRTEENTH SCHEDULE RIVERTON
ALL that parcel of land in the Town of Riverton, containing by admeasurement 3 acres 3 roods, being Sections 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, and 15, Block XVII. Bounded on the north-west by High Street; on the north-east by Priory Place; on the south-east by Pitt Street; and on the south-west by Essex Place.
