An Act to amend “The Sea-fisheries Act, 1894.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Sea-fisheries Act Amendment Act, 1895,”
and it shall be read with “The Sea-fisheries Act, 1894”
(hereinafter called “the principal Act”
).
2 Power to enter and search for fish or oysters illegally taken.
Any Collector of Customs, or Inspector, or other officer appointed under the principal Act, or any constable, may at any time between sunrise and sunset, with or without warrant, enter any fish-shop and premises attached thereto, smoke-house, vessel, boat, or in or. upon any public place as defined by section eighteen of “The Police Offences Act, 1884,”
and there search for fish or oysters supposed to be illegally taken, and open boxes, bags, and other receptacles in the course of such search.
Every person who in any way prevents or hinders such entry or search commits an offence against the principal Act, and is liable accordingly.
3 Amendments of principal Act.
The principal Act is hereby amended as follows:—
Area of exclusive license.
(1.)
As to section twenty-one, by repealing the last sentence of the section and inserting in lieu thereof the following:—
“Every such exclusive license shall comprise such area below high-water mark, and such frontage on the foreshore, or between the limits of high and low water, as the Governor thinks fit, and shall be sold by public tender or auction.”
Penalty for having oysters in possession.
(2.)
As to. subsection two of section forty-seven, by adding at the end of that subsection the following words: “Or who, during any close season for oysters, buys, sells, exposes for sale, or has in his possession any oysters, wherever taken.”
4 Repeal.
Subsection four of section forty-seven of the principal Act is hereby repealed.
