An Act to amend “The Manual and Technical Instruction Act, 1900.”
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
The Short Title of this Act is “The Manual and Technical Instruction Act, 1902”
; and it shall form part of and be read together with “The Manual and Technical Instruction Act, 1900”
(hereinafter referred to as “the principal Act”
).
2 Amendments of principal Act.
The principal Act is hereby amended as follows:—
(1.)
As to section four thereof—
(a.)
By repealing the words “and held during the ordinary school-hours,”
in subsection one thereof;
(b.)
By adding at the end of subsection three thereof the words “or any City Council, Borough Council, County Council, or other local authority: Provided that where a School Committee joins with a public association or a local authority to establish associated classes the Board of Education shall be the controlling authority”
; and
(c.)
By adding the following new subsection five: “Where school classes or special classes are not established by a Board of Education, the School Committee may establish such classes, and in every such case the Board of Education shall be the controlling power.”
(2.)
As to section seven thereof: By inserting, after the words “public associations,”
the words “and local authorities.”
(3.)
As to section nine thereof: By repealing the word “capitation”
in the second proviso to subsection one thereof.
(4.)
As to section ten thereof: By adding thereto the following proviso:—
“Provided also that this section shall not apply to such classes for teachers or itinerant classes in country districts as may be recognised by the Minister.”
(5.)
As to section sixteen thereof—
(d.)
By adding, after the words “to any controlling authority,”
the words “or managers of associated classes”
;
(e.)
By adding, after the words “under this Act,”
the words “and may for that purpose make a grant by lease or otherwise of lands or buildings, any Act to the contrary notwithstanding.”
(6.)
As to section seventeen thereof—
(f.)
By adding, after the words “received by any controlling authority,”
the words “or managers of associated classes.”
3 Managers a corporate body.
The managers appointed under section seven of the principal Act shall be a corporate body under the name of “The Managers of the Associated Classes.”
4 Conditions as to capitation.
(1.)
In no case shall any capitation payment be made in respect of any class unless the Minister is satisfied that the class has been efficiently and regularly instructed by a competent instructor, nor unless the claim for payment is rendered to the Minister within three months after the end of the year.
Repeal.
(2.)
This section is in substitution of section eleven of the principal Act, which section is hereby accordingly repealed.
