Contents
An Act to amend the Defence Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Defence Amendment Act, 1908, and shall be read together with and deemed part of the Defence Act, 1908 (hereinafter referred to as the principal Act).
2 Section 48 of principal Act amended.
Section forty-eight of the principal Act is hereby amended by omitting from subsection two thereof all words after the word “district,”
and substituting therefor the words “who shall forward such report to the Council of Defence.”
3 Section 51 of principal Act amended.
Section fifty-one of the principal Act is hereby amended by repealing paragraph (a) thereof, and substituting the following paragraph therefor:—
“(a.)
The Council of Defence may, on the recommendation of the officer commanding a district, and after due inquiry by such commanding officer, dismiss any Volunteer not being a commissioned officer, and strike his name out of the muster roll of the corps, for disobedience of any lawful command or order of any of his superior officers while doing any military duty with his corps, or for neglect of duty, or misconduct by him as a member of the corps, or for other sufficient cause; the existence or sufficiency of such cause respectively to be determined by the Council of Defence.”
4 Section 51 of principal Act further amended.
Section fifty-one of the principal Act is hereby further amended by adding thereto the following paragraph:—
“(c.)
An officer commanding a district may disrate any non-commissioned officer thereof for any of the causes mentioned in paragraph (a) of this section, the existence or sufficiency of such cause to be determined by such district commanding officer.”
5 Repeal.
Section fifty-three of the principal Act is hereby repealed, and the following substituted therefor:—
“Every case of summary dismissal of a Volunteer shall without delay be reported, with the attendant circumstances, to the Governor, who may signify his pleasure thereupon and give such directions as he thinks fit with respect to such dismissal.”
6 Section 156 of principal Act amended.
Section one hundred and fifty-six of the principal Act is hereby amended by inserting, after the words “Volunteer corps,”
the words “or of an officer of the Defence Forces.”
