An Act to consolidate certain Enactments of the General Assembly relating to the Adoption in New Zealand of certain of the Laws of England and of the Acts of the Imperial Parliament.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
(1.)
The Short Title of this Act is “The English Laws Act, 1908.”
Enactments consolidated.
(2.)
This Act is a consolidation of the enactments mentioned in the First Schedule hereto.
2 Certain English laws as existing on 14th January, 1840, in force in New Zealand.
1858, No. 2, sec. 1
The laws of England as existing on the fourteenth day of January, one thousand eight hundred and forty, so far as applicable to the circumstances of New Zealand, and in so far as the same were in force in New Zealand immediately before the commencement of this Act, shall be deemed to continue in force in New Zealand and shall continue to be therein applied in the administration of justice accordingly:
Exept usury laws. 1880, No. 12, sec. 43
Provided that the laws of England relating to usury existing as aforesaid shall be deemed not to have extended to or been in force in New Zealand at any time.
3 Certain later Acts adopted.
1854, No. 1, sec. 1 1860, No. 19, sec. 2
The Imperial Acts cited in the Second Schedule hereto, in so far as the same were in force in New Zealand immediately before the commencement of this Act, shall be deemed to continue in force in New Zealand and shall be applied therein in the administration of justice in like manner as the laws referred to in the last preceding section are applied.
