Contents
An Act to amend the Education Act, 1908.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
(1.)
This Act may be cited as the Education Amendment Act, 1913, and shall form part of and be read together with the Education Act, 1908 (hereinafter referred to as the principal Act).
Commencement.
(2.)
This Act (except section fifteen hereof) shall commence on the first day of January, nineteen hundred and fourteen.
2 Meetings to be held at office of Board.
(1.)
All meetings of an Education Board shall be held at the office of that Board in the principal town of the district for which the Board is constituted.
(2.)
Section forty-one of the principal Act is hereby amended by omitting from subsection one the words “and places,”
and by omitting from subsection two the words “and place.”
3 Section 75 of principal Act amended.
Section seventy-five of the principal Act is hereby amended by adding to subsection one the following proviso:—
“Provided that in the case of the holder of a Junior National Scholarship the arrangements made in respect of his board and residence shall first be approved by the Board.”
4 Section 79 of principal Act amended.
Section seventy-nine of the principal Act is hereby amended by omitting paragraph (d).
5 Power to acquire land for certain purposes.
The body corporate or trustees of any secondary school or university college specified in the Eleventh Schedule to the principal Act, or of any high school established under section ninety-four of that Act, shall have power to hold, purchase, take, or otherwise acquire land as sites for any college or school buildings or teachers’ residences, or for any other purpose in connection with any such college or school.
6 Section 110 of principal Act amended.
(1.)
Subsection one of section one hundred and ten of the principal Act is hereby amended by inserting, after the words “in that month,”
the words “or on such later date (not being more than twenty-eight days later) as is fixed by the Board.”
Section 111 of principal Act amended.
(2.)
Subsection one of section one hundred and eleven of the principal Act is hereby amended by omitting the words “third Monday in April,”
and substituting the words “seventh day before the date of the election.”
Section 112 of principal Act amended.
(3.)
Section one hundred and twelve of the principal Act is hereby amended by inserting, after the word “displayed,”
the words “as soon as practicable”
; and by omitting all words after the words “such Committee.”
7 Section 113 of principal Act amended.
Subsection one of section one hundred and thirteen of the principal Act is hereby amended by omitting the words “thirty-first day of March,”
and substituting the words “last day of February.”
8 Section 145 of principal Act amended.
Section one hundred and forty-five of the principal Act is hereby amended by repealing subsection five, and substituting the following subsection therefor:—
“(5.)
Any boy or girl who is unfit to undergo physical drill shall be exempted therefrom in the manner prescribed by regulations.”
9 Section 146 of principal Act amended.
Section one hundred and forty-six of the principal Act is hereby amended by adding thereto the following subsection:—
“(3.)
In any proceedings under section one hundred and fifty-three hereof it shall be a defence that the child has been forbidden to attend school for want of cleanliness only if the parent satisfies the Court that the child was not absent from school for a longer period than was necessary in order to remove the cause for which he was so forbidden to attend school.”
10 Penalty for failure to enrol child on school register.
(1.)
Where a child who is required to be enrolled on the register of some public school is not so enrolled the parent of the child is liable to a fine not exceeding two pounds.
(2.)
The payment of any such fine shall not be a bar to further proceedings in case of further default.
Repeal.
(3.)
This section is in substitution for section one hundred and fifty-two of the principal Act, and that section and the Tenth Schedule to that Act are hereby accordingly repealed.
11 Section 153 of principal Act amended.
(1.)
Subsection one of section one hundred and fifty-three of the principal Act is hereby amended by omitting the words “subsection one of”
wherever they occur; and by omitting the words “every such week,”
and substituting the words “every week.”
(2.)
Subsection two of the said section one hundred and fifty-three is hereby amended by omitting all words down to and including the words “Provided that.”
12 Section 175 of principal Act amended.
Subsection one of section one hundred and seventy-five of the principal Act is hereby amended by omitting the words “thirty-first day of March,”
and substituting the words “last day of February.”
13 Section 5 of Amendment Act, 1908, amended.
Subsection five of section five of the Education Amendment Act, 1908, is hereby amended by omitting the words “Subgrade 1a,”
and substituting the words “Grade 1.”
14 Annual increments.
(1.)
Every teacher employed in any position in a public school shall so long as he remains in that position receive the annual increment mentioned in Part II of the First Schedule to the Education Amendment Act, 1908, as amended by this Act.
(2.)
Every such increment shall be by way of addition to the rate of salary payable on the thirty-first day of December immediately preceding, and shall commence,—
(a.)
In the case of a teacher employed in such a position on the first day of July in the year nineteen hundred and thirteen or any succeeding year, as from the first day of January next ensuing; and
(b.)
In the case of a teacher appointed to such a position after the first day of July in the year nineteen hundred and thirteen or any succeeding year, as from the first day of January next ensuing after the expiration of one year from the date of such appointment.
(3.)
Nothing in this section shall entitle any teacher to a salary higher than the maximum for the grade or subgrade of salary attached to his position.
(4.)
Section seven of the Education Amendment Act, 1908, is hereby amended by repealing subsection three, and by omitting from subsection four all words after the words “under this Act.”
15 Section 7 of Amendment Act, 1908, amended.
(1.)
Subsection eight of section seven of the Education Amendment Act, 1908, is hereby amended by omitting the words “two years,”
and substituting the words “three years,”
and by inserting, after the word “salary,”
the words “and allowances.”
(2.)
This section shall be deemed to have been in operation as from the first day of January, nineteen hundred and thirteen.
16 Schedules to Amendment Act, 1908, amended.
(1.)
The First Schedule to the Education Amendment Act, 1908, is hereby amended by omitting the table in Part II, and substituting therefor the First Schedule hereto.
(2.)
The Second Schedule to the Education Amendment Act, 1908, is hereby repealed, and the Second Schedule hereto substituted in lieu thereof.
(3.)
Section twenty-nine of the Education Amendment Act, 1910, and the Schedule to the same Act are hereby repealed.
(4.)
The Fourth Schedule to the Education Amendment Act, 1908, is hereby amended by adding the following:—
“Where a pupil-teacher lives at home, but is obliged to travel more than four miles daily each way to attend school, there shall be paid to him an additional sum (not exceeding £10 per annum) sufficient to defray the actual cost of such travelling.”
17 Section 5 of Amendment Act, 1910, amended.
Subsection one of section five of the Education Amendment Act, 1910, is hereby amended by inserting, after the words “at such times,”
the words “and to be held on such conditions.”

A “mixed school”

(a.)
In every school of Grade X there shall be added for each succeeding subgrade above Subgrade Xa an assistant with a salary of Grade 1, but in all other respects the staff and salaries in every such school shall be the same as in a school of Subgrade Xa.
(b.)
The number of male assistants in any school shall not exceed the number of female assistants.
(c.)
At least one of the first three assistants in any school shall be a woman.
(d.)
At least three of the first six assistants in any school shall be women.
(e.)
In the case of a school of Grade 0 the Board shall pay for or on account of the salary of the teacher the sum of £6 per annum for every pupil in average attendance.
(f.)
The number of assistants and pupil-teachers in a school shall be determined by the average attendance shown in column 1 hereof in the manner prescribed by regulations; such average attendance shall be the average attendance for a period immediately preceding not greater than one year.
(g.)
An assistant with a salary of Grade 1 may be substituted for two pupil-teachers.
II Separate Schools
(a.)
A “separate boys’ school”
is a school to which there are admitted boys belonging to any of the standard classes, or to any of the standard classes above Standard I or above Standard II, but no other pupils.
(b.)
A “separate girls’ school”
is a school to which there are admitted girls belonging to any of the standard classes, or to any of the standard classes above Standard I or above Standard II, but no other pupils.
(c.)
A “separate infants’ school”
is a school to which there are admitted all pupils belonging to classes not higher than Standard I or Standard II.
(d.)
No separate school (that is to say, no separate boys’ school, or separate girls’ school, or separate infants’ school) shall be established or maintained with less than 201 or more than 600 children in average attendance.
(e.)
The number of assistants and pupil-teachers in a school shall be determined by the average attendance shown in column 1 of the tables (i), (ii), and (iii) herein, in the manner prescribed by regulations; such average attendance shall be the average attendance for a period immediately preceding, not greater than one year.
(f.)
An assistant with a salary of Grade 1 may be substituted for two pupil-teachers.

III Side Schools
(a.)
A “side school”
is a school which is attached to another school and is distant more than a quarter of a mile but not more than three miles therefrom, and to which there are admitted pupils up to a class not higher than Standard IV and up to an age not higher than eleven years.
(b.)
A “main school”
is a school to which a side school is so attached.
(c.)
One school is attached to another within the meaning of the foregoing provisions when they have the same head teacher.
(d.)
Every side school shall be deemed to form part of the main school, and the grade and staff of the main school (together with the side school or side schools so forming part thereof) shall be determined accordingly.
(e.)
Notwithstanding the foregoing provisions, no main school or side school, taken separately, shall have a smaller number on its staff than if it were a mixed school of the same average attendance; and the additional teachers (if any) required in order to conform to this requirement shall receive salaries of Grade 1.
IV Part-time Schools
(a.)
A “part-time school”
is one of a group of schools taught by the same sole teacher, each school being situated at least three miles by the nearest practicable means of access from any other school of the same group, and being open for not less than eight hours a week on the average, all the schools of the group being open for not less than twenty hours a week in the aggregate.
(b.)
All the schools of a group of part-time schools shall be counted as one school. To ascertain the grade of the group of part-time schools the totals of the average attendance at the several schools of the group shall be added together; and the salary of the sole teacher of that group of schools shall be the salary attached to the grade so ascertained.
(c.)
If the teacher of a group of part-time schools is required by the Education Board to teach on six days during the week (provided that he teaches for at least twenty-four hours in each week) he shall receive the salary for the grade of school next higher than the grade in which that group of schools is placed.

(a.)
To the head teacher of a district high school there shall be payable by way of salary an amount of £30 per annum in addition to all other amounts payable to him under this Act.
(b.)
The head teacher shall devote the greater part of his time and attention to the supervision and instruction of the classes in the primary department.
(c.)
The number of teachers and pupil-teachers in the primary department of a district high school shall be the same as in a public school with the same average attendance as the primary department.
(d.)
There shall be no pupil-teachers employed in the secondary department of a district high school.
(e.)
The salaries of the teachers of the primary department other than the head teacher of the school shall be determined in the same manner as in the case of a mixed school of the same grade or subgrade as the district high school.
(f.)
The grade or subgrade of a district high school shall be determined in accordance with the average attendance in the primary department and the secondary department taken together.
(g.)
In the foregoing provisions the term “primary department”
means the classes up to and including Standard VI; and the term “secondary department”
means the classes of Standard VII—namely, the classes containing the pupils who are receiving instruction in such secondary, technical, or higher subjects as are prescribed.
