An Act to amend the Government Railways Act, 1908. [11th November, 1920.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Government Railways Amendment Act, 1920, and shall be read together with and deemed part of the Government Railways Act, 1908.
2 Classification Schedule of the Department amended.
(1.)
The Schedule to the Government Railways Amendment Act, 1919, is hereby amended as follows:—
(a.)
In respect of the reference to the “Signal Engineer”
(in the classification of Subdivision I of the First Division), by omitting the figures “800,”
in the column fixing the maximum rate of pay per annum, and substituting the figures “900”
; and by omitting the figure “3,”
in the column fixing the annual increments, and substituting the figure “5”
; and
(b.)
By repealing so much of the Schedule as relates to Subdivision II of the First Division and to the Second Division, and substituting therefor the Schedule to this Act.
(2.)
This section shall be deemed to have come into operation on the first day of April, nineteen hundred and twenty.
3 Officers to be classified in accordance with Schedule hereto as on 1st April, 1920
(1.)
The Minister shall cause all members, probationers, and apprentices in the service of the Department on the first day of April, nineteen hundred and twenty (other than members who are classified in Subdivision I of the First Division), to be classified as on that date in accordance with the classification set forth in the Schedule hereto, and shall fix the rate of pay of each such member, probationer, and apprentice, and the date on which his first annual increment (if any) begins to be payable:
Provided that—
(a.)
With respect to every member and probationer, the right to advance from one subgrade to another, or, where there are no subgrades, the right to receive any increase of pay in any year, shall in each case depend upon the efficiency and good conduct of that member or probationer, and no such advancement shall be made or increase payable unless the permanent head of the Department certifies in writing that the member or probationer is entitled thereto:
(b.)
Except in the case of promotion, or in any case where, by the Schedule hereto, the rate of pay of any member or probationer is fixed by reference to his age, no increase of the pay of any member or probationer shall begin earlier than twelve months after the date of his appointment or after the date on which his last previous increase began to be payable, as the case may be:
(c.)
In any case where, by the Schedule hereto, the rate of pay of any member or probationer is fixed by reference to his age, that member or probationer shall, subject to the foregoing provisions of this section, be entitled to an increase of pay in every year as from the date of his birthday.
(2.)
The Governor-General may from time to time make regulations prescribing tests of efficiency for officers in Subgrade 2 and Subgrade 4 of Grade 7 of Subdivision II of the First Division of the Department as classified in accordance with the Schedule hereto.
(3.)
In addition to the rates of pay herein provided for, the Governor-General may, by Order in Council, prescribe rates of special allowances to be paid to any members of the Second Division residing in isolated places, and may determine the conditions subject to which such allowances shall be payable.
4 Annual list of officers, with particulars as to classification, to be laid before Parliament.
There shall be prepared and laid before Parliament each year a list setting out in order of classification the names, status, and pay of each member, probationer, and apprentice, and the length of time be has been in the service of the Department.
5 Amended provisions as to computation of retiring-allowance.
Section eighty-four of the principal Act is hereby amended by omitting from subsection one the words “five years”
and “seven years,”
and in each case substituting the words “three years.”
6 Acquisition of land for dwellings for railway employees.
(1.)
The Governor-General may, by Proclamation, take any land required as sites for dwellings for the accommodation of employees of the Department, and the provisions of the Public Works Act, 1908, and the principal Act, 19(8, relating to the taking of land for the purpose of a railway shall, with the necessary modifications, apply with respect to the taking of land under the authority of this section.
(2.)
This section shall not be construed to prevent any such dwelling from being occupied by any person who is not an employee of the Department if in the opinion of the permanent head such occupation is desirable.
Vacation of houses when men cease to be on the Railway staff.
(3.)
If any such dwelling is in the occupation of a person other than an employee of the Department, any Magistrate may, on application in that behalf by the permanent head, make an order of ejectment or for recovery of possession, notwithstanding the provisions of Part I of the War Legislation Amendment Act, 1916, or of any enactment amending the same, if he is satisfied that the dwelling is required by the Department for the occupation of an employee of the Department.

When there are subgrades within any grade promotion within such grade shall commence at the lowest subgrade, and shall, subject to the provisions of this Act and of the principal Act and of any regulations thereunder, proceed in each case by annual increment from each subgrade to the next highest subgrade until the highest subgrade within such grade is reached:
Provided, however, that engineering and draughting cadets shall, on being promoted to Grade 7, commence in Subgrade 2 of the said grade.
Engineering (civil, mechanical, and draughting) cadets shall be entitled to receive £10 per annum in addition to the rates specified for Grade 8, until completion of their cadetship.
Members of Grade 8 living away from their homes shall be paid lodging-allowance at the rate of £40 per annum while in Subgrade 1, £30 per annum while in Subgrade 2, and £20 per annum while in Subgrade 3.
Members of Grade 8 (other than engineering cadets) who pass the Matriculation Examination of the University of New Zealand shall be entitled to count twelve months’ service therefor, and who pass with credit the prescribed examination for candidates for admission to the Public Service of New Zealand shall be entitled to count six months’ service therefor. This provision shall not apply in the case of engineering cadets who are transferred to the clerical staff.
Members of Grade 8 (other than engineering cadets) who are certified by competent teachers as able to write one hundred words per minute in shorthand and to type forty words per minute on the typewriter shall be entitled to count nine months’ service for such certificate if in the case of youths who have passed the examination prescribed for candidates for admission to the Public Service shorthand was not one of the subjects taken to enable them to pass.
