An Act to authorize the Collection in New Zealand on Behalf of His Majesty’s Government in the United Kingdom of certain Colonial Light Dues imposed by His Majesty under Section Six hundred and seventy of the Merchant Shipping Act, 1894 (Imperial).
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title.
This Act may be cited as the Colonial Light Dues Act, 1935.
2 Colonial light dues payable under section 670 of Merchant Shipping Act, 1894, may be collected in New Zealand.
Where any ship arrives at any port in New Zealand without there having theretofore been paid any colonial light dues payable in respect of that ship by virtue of the Order in Council set out in the Schedule hereto or any other Order in Council hereafter made under section six hundred and seventy of the Merchant Shipping Act, 1894 (Imperial), such dues shall, in accordance with the following provisions of this Act, be paid in New Zealand.
3 Dues payable in currency of United Kingdom or its equivalent in New Zealand currency.
Colonial light dues payable in New Zealand in accordance with this Act shall be paid either in the currency of the United Kingdom or in the currency of New Zealand. Where dues are paid in the currency of New Zealand the amount payable shall be such amount as, having regard to the rate of exchange prevailing at the time of payment, represents the equivalent, in the currency of the United Kingdom, of the dues so payable.
4 Application of certain provisions of Shipping and Seamen Act, 1908.
Subsections one and two of section two hundred and eighty-eight, and sections two hundred and eighty- nine and two hundred and ninety of the Shipping and Seamen Act, 1908, shall apply to colonial light dues payable in New Zealand in accordance with this Act in all respects as if they were light dues payable under section two hundred and eighty-seven of that Act.
5 Dues to be property of His Majesty’s Government in United Kingdom.
All colonial light dues payable in New Zealand in accordance with this Act shall be paid to the Collector of Customs at the port of arrival. Such dues shall be the property of and shall be accounted for to His Majesty’s Government in the United Kingdom.
6 Remission or waiver of dues in certain cases.
Notwithstanding anything to the contrary in the foregoing provisions of this Act, any colonial light dues to which this Act applies may be remitted in whole or in part, or waived, in such cases as may be approved in that behalf by His Majesty’s Government in the United Kingdom.

Whereas by section 670 of the Merchant Shipping Act, 1894, it is provided that where any lighthouse, buoy or beacon has been erected or placed on or near the coasts of any British possession by or with the consent of the legislature of that possession His Majesty may by Order in Council fix such dues (in that Act referred to as colonial light dues) to be paid in respect of that lighthouse, buoy or beacon by the owner or master of every ship which passes the same and derives benefit therefrom as His Majesty may deem reasonable and may by like Order increase, diminish or repeal such dues, and those dues shall from the time mentioned in the Order be leviable throughout His Majesty’s dominions and further that colonial light dues shall not be levied in any British possession unless the legislature of that possession has by address to the Crown or by Act or Ordinance duly passed signified its opinion that the dues ought to be levied:
And whereas the lighthouses and buoy specified in the Schedule hereto have been erected or placed on or near the coasts of the Bahamas and the Leeward Islands by or with the consent of the legislatures of those Possessions:
Now, therefore, His Majesty, in pursuance of the powers in that behalf vested in Him by the said section and by and with the advice of His Privy Council, is pleased to fix and doth hereby fix the dues to be paid in respect of the lighthouses and buoy specified in the first part of the said Schedule by the owner or master of every ship at one penny per ton of her register tonnage for every occasion after the first day of April, 1932, on which such ship passes and derives benefit from any of the said lighthouses or the said buoy.
And His Majesty is further pleased to fix and doth hereby fix the dues to be paid in respect of the lighthouse specified in the second part of the said Schedule by the owner or master of every ship at a half-penny per ton of her register tonnage for every occasion after the first day of April, 1932, on which such ship passes and derives benefit from the said lighthouse.
