AN ACT to amend the War Pensions and Allowances (Mercantile Marine) Act, 1940.
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:—
1 Short Title and commencement.

(1)
This Act may be cited as the War Pensions and Allowances (Mercantile Marine) Amendment Act, 1943, and shall be read together with and deemed part of the War Pensions and Allowances (Mercantile Marine) Act, 1940 (hereinafter referred to as the principal Act).
(2)
This Act shall be deemed to have come into force on the first day of July, nineteen hundred and forty-three.
2 Increasing rates of pensions and allowances.
The principal Act is hereby amended by repealing the First, Second, and Third Schedules, and substituting therefor respectively the First, Second, and Third Schedules to this Act.
3 Special provisions as to persons in receipt of pensions or allowances from any other Government within British dominions.
(1)
Subject to the provisions of this section, the War Pensions Board, with the approval of the Minister, may grant a pension or allowance under the principal Act to any member of a mercantile marine other than the New Zealand mercantile marine who is in receipt of a pension or allowance from any Government within the British dominions (other than the Government of New Zealand) in respect of his disablement or detention during the present war.
(2)
The Board may, in like manner, grant a pension or allowance under the principal Act, in respect of the death, disablement, or detention of any member of a mercantile marine other than the New Zealand mercantile marine, to any person who would be a dependant of that member if he were a member of the New Zealand mercantile marine.
(3)
No pension shall be granted under this section to or in respect of any member of a mercantile marine other than the New Zealand mercantile marine unless the Board is satisfied—
(a)
That the member to or in respect of whom the pension or allowance is granted was, immediately prior to the commencement of the present war, a bona fide resident of New Zealand; and
(b)
That the claimant for a pension or allowance under this section is actually resident in New Zealand.
(4)
No pension or allowance shall be granted under this section to any person of such an amount that the total amount receivable by or on account of that person by way of pension or allowance (including any pension or allowance granted out of New Zealand) shall exceed the amount of the pension or allowance that would have been payable to him if the member in respect of whose death, disablement, or detention the pension or allowance is granted had been a member of the New Zealand mercantile marine.
