An Act to amend the Government Railways Act 1949

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Government Railways Amendment Act 1962, and shall be read together with and deemed part of the Government Railways Act 1949 (hereinafter referred to as the principal Act).

2 Minister’s liability for carriage of passengers and goods

Section 13 of the principal Act is hereby amended by inserting in subsection (4), after the word “shall”, the words “notwithstanding anything to the contrary in the Sea Carriage of Goods Act 1940 and the Carriers Act 1948”.

3 Limit of liability for goods unless value declared and increased charge paid

Section 23 of the principal Act is hereby amended by inserting in paragraph (b), after the word “recover”, the words “from the Crown or the Department or the Minister or any employee, or from any agent for the purposes of this Act of the Crown or the Department or the Minister,”.

4 Scales of charges

Section 33 of the principal Act is hereby amended—

By omitting from subsection (2) the words “if such special charges are publicly notified”:

By omitting from subsection (4) the word “such”:

By inserting in subsection (4), after the word “including”, the words “terms and conditions with respect to the conveyance of passengers and”:

(d)

By omitting from the proviso to subsection (5) the words “if such special terms and conditions are publicly notified”.

This Act is administered in the New Zealand Government Railways Department.
