An Act to amend the Agricultural Chemicals Act 1959
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Agricultural Chemicals Amendment Act 1968, and shall be read together with and deemed part of the Agricultural Chemicals Act 1959 (hereinafter referred to as the principal Act).
2 Powers of Inspectors
Section 24a of the principal Act (as inserted by section 13 of the Agricultural Chemicals Amendment Act 1967) is hereby amended by inserting in subsection (2), after the word “vehicle”
, the words “aircraft, ship, vessel,”
.
3 Obstructing or assaulting authorised person
The principal Act is hereby further amended by inserting, after section 29a (as inserted by section 16 of the Agricultural Chemicals Amendment Act 1967), the following section:
“29b.
Every person commits an offence against this Act and is liable on summary conviction to a fine not exceeding two hundred dollars who—
“(a)
Wilfully obstructs, hinders, or deceives, or wilfully causes to be obstructed, hindered, or deceived, any Inspector or member of the Police or other authorised person, while the Inspector or member of the Police or authorised person is exercising or performing any of his powers, duties, and functions under this Act; or
“(b)
Threatens or assaults any person referred to in paragraph (a) of this subsection, while that person is engaged in the exercise or performance of any such power, function, or duty; or
“(c)
Fails to comply with the lawful requirements of, refuses to supply any information lawfully required by, or knowingly supplies false or misleading information to, any person referred to in the said paragraph (a), while that person is engaged in the exercise or performance of any such power, function, or duty.”
This Act is administered in the Department of Agriculture.
