An Act to amend the Visiting Forces Act 1939
BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:
1 Short Title
This Act may be cited as the Visiting Forces Amendment Act 1981, and shall be read together with and deemed part of the Visiting Forces Act 1939 (hereinafter referred to as the principal Act).
2 Sentencing powers of courts-martial
Section 6 of the principal Act is hereby amended by inserting, after subsection (3), the following subsection:
“(3a)
Where a court-martial of a home force or an officer of that force is exercising jurisdiction in respect of a member of another force who is by virtue of this section attached temporarily to a home force, then, subject to any Order in Council made under subsection (3) of this section, the court-martial or officer shall have the same sentencing powers in relation to that member’s service in the force to which he belongs as it or he would have had in relation to his service in the home force to which he is attached temporarily had he been a member of that home force; and for that purpose a sentence of dismissal or discharge from Her Majesty’s service shall be deemed to be a sentence of dismissal or discharge from the service to which the defendant belongs.”
