An Act to amend the Carter Observatory Act 1938

BE IT ENACTED by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same, as follows:

1 Short Title

This Act may be cited as the Carter Observatory Amendment Act 1981, and shall be read together with and deemed part of the Carter Observatory Act 1938 (hereinafter referred to as the principal Act).

2 Constitution of Board

(1)

The principal Act is hereby amended by repealing section 5, and substituting the following section:

“5

“(1)

The Board shall consist of 10 persons to be appointed as follows:

“(a)

Five shall be appointed by the Minister:

“(b)

Two shall be appointed by the Minister on the nomination of the Council of the Royal Society of New Zealand:

“(c)

Two shall be appointed by the Minister on the nomination of the Wellington City Council:

“(d)

One shall be appointed by the Minister to represent those local authorities, other than the Wellington City Council, making financial contributions to the Board pursuant to section 18 of this Act.

“(2)

The members of the Board shall be appointed for a term not exceeding 5 years, but every member shall, unless he sooner vacates office under section 5a of this Act, continue in office until his successor comes into office.”

(2)

The following enactments are hereby consequentially repealed:

(a)

Section 4 of the Carter Observatory Amendment Act 1972:

(b)

Section 5 of the Carter Observatory Amendment Act 1977.

(3)

This section shall be deemed to have come into force on the 1st day of January 1981.

3 Extraordinary vacancies

Section 5a(1) of the principal Act (as inserted by section 5 of the Carter Observatory Amendment Act 1972) is hereby amended by omitting the words “Governor-General” in both places where they occur, and substituting in each case the word “Minister”.

This Act is administered in the Department of Scientific and Industrial Research.
